HOUSE BILL NO. 331

TRANSPORTATION:  Authorizes transportation network companies to provide
nonemergency medical transportation services through the state Medicaid program
1	AN ACT
2To enact R.S. 48:2206, relative to transportation network companies; to authorize
3 transportation network companies to provide nonemergency medical transportation
4 through the state Medicaid program; to establish company and driver requirements;
5 to provide for the promulgation of rules; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 48:2206 is hereby enacted to read as follows:
8 ยง2206.  Nonemergency medical transportation
9	A.  Notwithstanding any provision of law to the contrary and subject to
10 compliance with applicable federal Medicaid and Medicare requirements, a
11 transportation network company may connect a driver to a rider for the purpose of
12 providing nonemergency medical transportation services within the state through the
13 Louisiana Medicaid program, if all of the following conditions are met:
14	(1)  The company has complied with the requirements set forth in this
15 Chapter.
16	(2)  All drivers and prospective drivers have been screened pursuant to the
17 procedures set forth in R.S. 48:2199.
18	(3)  The company is under contract with one of the following:
19	(a)  A Medicaid managed care organization.

1	(b)  A transportation broker that is under contract with a Medicaid managed
2 care organization.
3	(c)  A transportation broker that is under contract with the Department of
4 Health, bureau of health services financing.
5	B.  If at least one of the requirements in Paragraph (3) of this Subsection are
6 not met, the company shall receive referrals from a transportation broker that is
7 under contract with a Medicaid managed care plan or the Department of Health,
8 bureau of health services financing.
9	C.  The Department of Health shall promulgate rules and regulations as are
10 necessary for the implementation of this Section by October 1, 2020.  Requirements
11 imposed for companies and drivers to act as Medicaid transportation providers,
12 including requirements for enrollment and specifications for the vehicles used, may
13 not exceed those imposed by R.S. 48:2191 through 2203, except as necessary to
14 conform to applicable federal Medicaid transportation requirements administered by
15 the Department of Health, bureau of health services financing.
16	D.  Nothing in this Section shall be construed to authorize a company, a
17 driver, or a vehicle to violate the provisions of R.S. 48:2205.

Abstract:  Authorizes transportation network companies to provide nonemergency medical
transportation services through the state Medicaid program when certain conditions
are met.
Proposed law authorizes a transportation network company to provide nonemergency
medical transportation services within the state through the La. Medicaid program when:
(1)The company has complied with all of the requirements of transportation network
companies.
(2)The drivers and prospective drivers have been screened as set forth in present law.
(3)The company is under contract with a Medicaid managed care organization, a
transportation broker that is under contract with a Medicaid managed care

organization, or a transportation broker that is under contract with the Dept. of
Health, bureau of health services financing.
Proposed law requires that the company receive referrals from a transportation broker that
is under contract with a Medicaid managed care plan or the Dept. of Health, bureau of health
services financing, if the company is not under contract as required in proposed law.
Proposed law requires the Dept. of Health, bureau of health services financing, to
promulgate rules and regulations as are necessary for the implementation of proposed law
by Oct. 1, 2020.
Proposed law specifies that the requirements for companies and drivers to act as Medicaid
transportation providers, including requirements for enrollment and specifications for
vehicles used, may not exceed the requirements imposed under present law, except as
necessary to conform with applicable federal Medicaid transportation requirements.
Proposed law specifies that the provisions of proposed law do not authorize a company, a
driver, or a vehicle to violate the provisions of present law.
