HOUSE BILL NO. 335
BY REPRESENTATIVE HUVAL
BOARDS/COMMISSIONS:  Authorizes the lieutenant governor and the secretary of the
Department of Culture, Recreation and Tourism to designate a person to serve in
their stead on certain boards and commissions
1	AN ACT
2To amend and reenact R.S. 25:341(D)(introductory paragraph) and 891(A)(3), R.S.
3 40:2501(B)(1) and (G), R.S. 49:1112(B)(3)(k), and Section 1 of Act No. 130 of the
4 1896 Regular Session of the Legislature, as amended by Act No. 395 of the 2006
5 Regular Session of the Legislature, relative to the membership of certain boards and
6 commissions; to provide relative to the membership held by the lieutenant governor
7 and the secretary of the Department of Culture, Recreation and Tourism; to authorize
8 the lieutenant governor and secretary to designate persons to serve on such boards
9 and commissions in their stead; and to provide for related matters.
10Be it enacted by the Legislature of Louisiana:
11 Section 1.  R.S. 25:341(D)(introductory paragraph) and 891(A)(3) are hereby
12amended and reenacted to read as follows:
13 §341.  Establishment and location; purpose; board of directors; appointment;
14	compensation of members; terms; oaths

16	D.  The Board of Directors board of directors of the Louisiana State Museum
17 shall be composed of members as provided in this Subsection.  The secretary of the
18 Department of Culture, Recreation and Tourism, or his designee, shall serve as a
19 member of the board.  Each additional member of the board shall have a knowledge

1 of and interest in art, history, and cultural restoration.  Further, each member
2 nominee shall have experience in at least one of the following subject areas:
3 marketing, law, historic preservation, museum sciences, finance, accounting,
4 business administration, fundraising for nonprofits, facility management, community
5 or consumer advocacy, or other pertinent disciplines.  Additional members of the
6 board shall be appointed by the lieutenant governor as follows:

12	(3)  The secretary of the Department of Culture, Recreation and Tourism and
13 the assistant secretary of the office of cultural development shall serve as ex officio
14 members of the council.  The secretary may designate a person to serve as a member
15 of the council in his absence.

17 Section 2.  R.S. 40:2501(B)(1) and (G) are hereby amended and reenacted to read as
18follows:
19 §2501.  Interagency Recreation Board; creation; officers

21	B.  The board shall be comprised of seven members as follows:
22	(1)(a)  The secretary of the Department of Public Safety and Corrections, the
23 secretary of the Louisiana Department of Health, and the secretary of the Department
24 of Culture, Recreation and Tourism, each of whom shall be an ex officio member
25 with full voting rights and all other rights of members.
26	(b)  The secretary of the Department of Culture, Recreation and Tourism may
27 designate a person to serve as a member of the board in his absence.  Any such

1person shall have the full voting rights and all other rights granted to the secretary as a
2member of the board.

4	G.  The governor shall select a chairman of the board and each year the board
5 shall elect three of its members from whom the governor shall select one person to
6 serve as vice chairman of the board.  The secretary of the Department of Culture,
7 Recreation and Tourism, or his designee, shall serve as secretary of the board.  The
8 vice chairman shall act as chairman in the absence or disability of the chairman or
9 in the event of a vacancy in the chairmanship.

11 Section 3.  R.S. 49:1112(B)(3)(k) is hereby amended and reenacted to read as
12follows:
13 §1112.  Commission established; purposes; membership; officers

17	(3)  The commission shall include:

19	(k)  The lieutenant governor as an ex officio nonvoting member.  The
20 lieutenant governor may designate a person to serve as a member of the commission
21 in his absence.

23 Section 4.  Section 1 of Act No. 130 of the 1896 Regular Session of the Legislature
24as amended by Act No. 395 of the 2006 Regular Session of the Legislature is hereby
25amended and reenacted to read as follows:
26	Section 1.  Be it enacted by the General Assembly of the State of Louisiana,
27 That:
28	(A)  The park in the City of New Orleans known as the "New Orleans City
29 Park" be and is hereby placed under control and management of the "New Orleans

1 City Park Improvement Association" incorporated under the laws of the State, by an
2 act before Felix J. Dreyfous, Notary Public, on the 13

 day of August, 1891.
3	(B)  The secretary of the Department of Culture, Recreation and Tourism
4 shall be a member of the board of commissioners of the New Orleans City Park
5 Improvement Association.  The secretary may designate a person to serve as a
6 member of the board of commissioners in his absence.

Abstract:  Authorizes the lieutenant governor and secretary of the Dept. of Culture,
Recreation and Tourism to have designees serve in their absence on certain boards
and commissions.
Present law (R.S. 25:341) provides that the La. State Museum is established as a complex
of facilities in the cities of Baton Rouge, Natchitoches, New Orleans, Patterson, Thibodaux,
and Winnfield under the management and supervision of the office of the state museum of
the Dept. of Culture, Recreation and Tourism (department).  Provides that the museum is
governed by a board of directors, which includes the secretary of the department.
Proposed law retains present law but provides that the secretary's designee may serve in his
stead.
Present law (R.S. 25:841) provides that the La. State Arts Council is created and established
as an agency of the state.  Provides that the council consists of 24 members, including the
secretary of the department.
Proposed law retains present law but authorizes the secretary to designate a person to serve
as a member of the council in his absence.
Present law (R.S. 40:2501) creates the Interagency Recreation Bd. as a state agency in the
Dept. of Public Safety and Corrections.  Provides that the board is comprised of seven
members, including the secretary of the department.  Provides the secretary has full voting
rights and all other rights of board members.  Provides that the secretary of the department
shall serve as secretary of the board.
Proposed law retains present law but authorizes the secretary to designate a person to serve
as a member of the board in his absence.  Provides that the person has full rights and all
other rights granted to the secretary.
Present law (R.S. 49:1112) provides that the Volunteer La. Commission is established in the
executive branch of state government in the office of the lieutenant governor.  Provides that
the commission shall consist of no fewer than 15 and no more than 25 voting members.
Provides that the lieutenant governor serves as a nonvoting member.
Proposed law retains present law but authorizes the lieutenant governor to designate a person
to serve as a member of the board in his absence.

Present law (Act No. 130 of 1896 R.S., §1) provides that New Orleans City Park is placed
under control and management of the New Orleans City Park Improvement Assoc.
incorporated under the laws of the state, by an act before Felix J. Dreyfous, Notary Public,
on the 13th day of August 1891.  Provides that the secretary shall be a member of the board
of commissioners.
