HOUSE BILL NO. 335
BY REPRESENTATIVE HUVAL
1	AN ACT
2 To amend and reenact R.S. 25:341(D)(introductory paragraph) and (E)(1), and 891(A)(3),
3 R.S. 40:2501(B)(1), (G), and (I), R.S. 49:1112(B)(3)(k), and Section 1 of Act No.
4 130 of the 1896 Regular Session of the Legislature, as amended by Act No. 395 of
5 the 2006 Regular Session of the Legislature, relative to the membership of certain
6 boards and commissions; to provide relative to the membership held by the
7 lieutenant governor and the secretary of the Department of Culture, Recreation and
8 Tourism; to authorize the lieutenant governor and secretary to designate persons to
9 serve on such boards and commissions in their stead; and to provide for related
10 matters.
11 Be it enacted by the Legislature of Louisiana:
12 Section 1.  R.S. 25:341(D)(introductory paragraph) and (E)(1) and 891(A)(3) are
13 hereby amended and reenacted to read as follows:
14 §341.  Establishment and location; purpose; board of directors; appointment;
15	compensation of members; terms; oaths

17	D.  The Board of Directors board of directors of the Louisiana State Museum
18 shall be composed of members as provided in this Subsection.  The secretary of the
19 Department of Culture, Recreation and Tourism, or his designee, shall serve as a
20 member of the board.  Each additional member of the board shall have a knowledge
21 of and interest in art, history, and cultural restoration.  Further, each member
22 nominee shall have experience in at least one of the following subject areas:
23 marketing, law, historic preservation, museum sciences, finance, accounting,
24 business administration, fundraising for nonprofits, facility management, community

1 or consumer advocacy, or other pertinent disciplines.  Additional members of the
2 board shall be appointed by the lieutenant governor as follows:

5 be submitted to the Senate for confirmation.

11	(3)  The secretary of the Department of Culture, Recreation and Tourism and
12 the assistant secretary of the office of cultural development shall serve as ex officio
13 members of the council.  The secretary may designate a person to serve as a member
14 of the council in his absence.  Such designee shall be submitted to the Senate for
15 confirmation.

17 Section 2.  R.S. 40:2501(B)(1), (G), and (I) are hereby amended and reenacted to
18 read as follows:
19 §2501.  Interagency Recreation Board; creation; officers

21	B.  The board shall be comprised of seven members as follows:
22	(1)(a)  The secretary of the Department of Public Safety and Corrections, the
23 secretary of the Louisiana Department of Health, and the secretary of the Department
24 of Culture, Recreation and Tourism, each of whom shall be an ex officio member
25 with full voting rights and all other rights of members.
26	(b)  The secretary of the Department of Culture, Recreation and Tourism may
27 designate a person to serve as a member of the board in his absence.  Any such

1 person shall have the full voting rights and all other rights granted to the secretary as a
2 member of the board.

4	G.  The governor shall select a chairman of the board and each year the board
5 shall elect three of its members from whom the governor shall select one person to
6 serve as vice chairman of the board.  The secretary of the Department of Culture,
7 Recreation and Tourism, or his designee, shall serve as secretary of the board.  The
8 vice chairman shall act as chairman in the absence or disability of the chairman or
9 in the event of a vacancy in the chairmanship.

11	I.  Each appointment by the governor and each designee shall be submitted
12 to the Senate for confirmation.
13 Section 3.  R.S. 49:1112(B)(3)(k) is hereby amended and reenacted to read as
14 follows:

19	(3)  The commission shall include:

21	(k)  The lieutenant governor as an ex officio nonvoting member.  The
22 lieutenant governor may designate a person to serve as a member of the commission
23 in his absence.  Such designee shall be submitted to the Senate for confirmation.

25 Section 4.  Section 1 of Act No. 130 of the 1896 Regular Session of the Legislature
26 as amended by Act No. 395 of the 2006 Regular Session of the Legislature is hereby
27 amended and reenacted to read as follows:

1	Section 1.  Be it enacted by the General Assembly of the State of Louisiana,
2 That:
3	(A)  The park in the City of New Orleans known as the "New Orleans City
4 Park" be and is hereby placed under control and management of the "New Orleans
5 City Park Improvement Association" incorporated under the laws of the State, by an
6 act before Felix J. Dreyfous, Notary Public, on the 13
th
 day of August, 1891.
7	(B)  The secretary of the Department of Culture, Recreation and Tourism
8 shall be a member of the board of commissioners of the New Orleans City Park
9 Improvement Association.  The secretary may designate a person to serve as a
10 member of the board of commissioners in his absence.
