ATTORNEYS: (Constitutional Amendment) Provides relative to the amount an attorney
can advance to his client
1 A JOINT RESOLUTION
2Proposing to amend Article V, Section 5(B) of the Constitution of Louisiana, relative to the
3 supreme court's exclusive jurisdiction over members of the bar; to allow attorneys
4 providing financial assistance to clients to be regulated as provided by law; to
5 provide for submission of the proposed amendment to the electors; and to provide
6 for related matters.
7 Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members
8elected to each house concurring, that there shall be submitted to the electors of the state of
9Louisiana, for their approval or rejection in the manner provided by law, a proposal to
10amend Article V, Section 5(B) of the Constitution of Louisiana, to read as follows:
11 §5. Supreme Court; Jurisdiction; Rule-Making Power; Assignment of Judges

13 (B) Original Jurisdiction. The supreme court has exclusive original
14 jurisdiction of disciplinary proceedings against a member of the bar, except with
15 regard to members of the bar providing financial assistance to clients. Members of
16 the bar providing financial assistance to clients shall be regulated as provided by law.

18 Section 2. Be it further resolved that this proposed amendment shall be submitted
19to the electors of the state of Louisiana at the statewide election to be held on November 3,
202020.

2there shall be printed a proposition, upon which the electors of the state shall be permitted
3to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
4follows:
5 Do you support an amendment to have attorneys providing financial
6 assistance to clients be regulated as provided by law? (Amends Article V,
7 Section 5(B))

Present constitution provides that the supreme court has exclusive original jurisdiction of
disciplinary proceedings against members of the bar.
Proposed constitutional amendment retains present constitution with the exception that
attorneys providing financial assistance to clients shall be regulated as provided by law.
Provides for submission of the proposed amendment to the voters at the statewide election
to be held Nov. 3, 2020.
