HOUSE BILL NO. 362

HOSPITALS:  Defines "freestanding children's hospital" for purposes of the Hospital
Licensing Law
1	AN ACT
2To enact R.S. 40:2102(5) and 2109.1, relative to freestanding children's hospitals; to provide
3 for a definition; to provide for newborn health services; and to provide for related
4 matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 40:2102(5) and 2109.1 are hereby enacted to read as follows: 
7 §2102.  Definitions
8	As used in this Part:

10	(5) "Freestanding children's hospital" means a fully functional hospital with
11 all of the support services and ancillary functions needed to furnish services
12 primarily to children below the age of eighteen.

14 §2109.1. Neonatal Intensive Care Units
15	A. In order to provide a neonatal intensive care unit, a facility shall be one
16 of the following:
17	(1)  A hospital as defined by R.S. 40:2102.
18	(2) A freestanding hospital as defined by the department in rule.
19	(3) A freestanding children's hospital, as defined by R.S. 40:2102.

Abstract:  Provides for freestanding children's hospitals to provide newborn services at their
facility. 
Proposed law defines "freestanding children's hospital" for the purposes of the Hospital
Licensing Law. 
Proposed law provides that hospitals, freestanding hospitals as provided for in present law,
and free-standing children's hospitals may be one of the three facilities that may provide a
neonatal intensive care unit.
