HOUSE BILL NO. 373
BY REPRESENTATIVE MCKNIGHT
DISTRICTS/CRIME PREVENT:  Provides relative to the Westminster Pine Park Crime
Prevention and Neighborhood Improvement District in East Baton Rouge Parish
1	AN ACT
2To amend and reenact R.S. 33:9097.11(F)(2) and (4)(b), relative to the Westminster Pine
3 Park Crime Prevention and Neighborhood Improvement District in East Baton
4 Rouge Parish; to provide relative to the parcel fee levied within the district; to
5 authorize an increase in the maximum amount of the fee, subject to voter approval;
6 to provide relative to the expiration of the fee; and to provide for related matters.
7	Notice of intention to introduce this Act has been published
8	as provided by Article III, Section 13 of the Constitution of
9	Louisiana.
10Be it enacted by the Legislature of Louisiana:
11 Section 1.  R.S. 33:9097.11(F)(2) and (4)(b) are hereby amended and reenacted to
12read as follows:
13 ยง9097.11.  Westminster Pine Park Crime Prevention and Neighborhood
14	Improvement District

16	F.  Parcel fee.  The governing authority of East Baton Rouge Parish is hereby
17 authorized to impose and collect a parcel fee within the district subject to and in
18 accordance with the provisions of this Subsection:

1	(2)  The amount of the fee shall be as requested by duly adopted resolution
2 of the governing authority of the district; however, the fee shall not exceed one
3 hundred thirty dollars per parcel per year.

7	(b)  The fee shall expire ten years from its initial levy at the time provided in
8 the proposition authorizing the fee, which shall not be more than ten years after its
9 imposition, but may be renewed as provided in Subparagraph (a) of this Paragraph. 
10 If renewed, the term of the imposition of the fee shall be as provided in the
11 proposition authorizing such renewal, not to exceed ten years.

13 Section 2.  This Act shall become effective upon signature by the governor or, if not
14signed by the governor, upon expiration of the time for bills to become law without signature
15by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
16vetoed by the governor and subsequently approved by the legislature, this Act shall become
17effective on the day following such approval.

Abstract:  Relative to the parcel fee levied in the Westminster Pine Park Crime Prevention
and Neighborhood Improvement District in East Baton Rouge Parish, authorizes an
increase in the maximum amount of the fee.
Present law creates and provides for the Westminster Pine Park Crime Prevention and
Neighborhood Improvement District in East Baton Rouge Parish as a political subdivision
of the state to aid in crime prevention and improvement of areas within the district.  Further
provides for the district's boundaries and for the governance of the district by a five-member
board of commissioners.
Proposed law retains present law.
Present law provides for the levy, subject to voter approval, of a parcel fee on improved
parcels within the district.  Provides that the fee shall not exceed $100 per parcel per year.

Proposed law authorizes an increase in the maximum amount of the parcel fee from $100
to $130 per parcel per year, subject to voter approval.
Present law provides that the fee expires 10 years after its initial imposition, but may be
renewed subject to voter approval.
Proposed law instead provides that the fee expires at the time provided in the proposition,
not more than 10 years after imposition, but may be renewed subject to voter approval.
Effective upon signature of governor or lapse of time for gubernatorial action.
