HLS 20RS-110 ORIGINAL 2020 Regular Session HOUSE BILL NO. 41 BY REPRESENTATIVE GREEN GOVERNOR/SUCCESSION: (Constitutional Amendment) Provides for gubernatorial succession 1 A JOINT RESOLUTION 2Proposing to amend and reenact Article IV, Section 14 of the Constitution of Louisiana, to 3 change the order of gubernatorial succession; to provide for submission of the 4 proposed amendment to the electors; and to provide for related matters. 5 Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members 6elected to each house concurring, that there shall be submitted to the electors of the state of 7Louisiana, for their approval or rejection in the manner provided by law, a proposal to 8amend Article IV, Section 14 of the Constitution of Louisiana, to read as follows: 9 §14. Vacancy in Office of Governor 10 Section 14. When a vacancy occurs in the office of governor, the order of 11 succession shall be (1) the elected lieutenant governor, (2) the elected secretary of 12 state the presiding officer of the House of Representatives, (3) the elected attorney 13 general the presiding officer of the Senate, (4) the elected treasurer the elected 14 secretary of state, (5) the presiding officer of the Senate the elected attorney general, 15 (6) the presiding officer of the House of Representatives the elected treasurer, and 16 then (7) as provided by law. The successor shall serve the remainder of the term for 17 which the governor was elected. 18 Section 2. Be it further resolved that this proposed amendment shall be submitted 19to the electors of the state of Louisiana at the statewide election to be held on November 3, 202020. Present constitution provides that in the event of a vacancy in the office of governor, the order of succession shall be as follows: (1)Elected lieutenant governor. (2)Elected secretary of state. (3)Elected attorney general. (4)Elected treasurer. (5)Presiding officer of the Senate. (6)Presiding officer of the House of Representatives. (7)As provided by law. Proposed constitutional amendment retains present constitution except to put the presiding officer of the House in the second position, behind the lieutenant governor, the presiding officer of the Senate in the third position, and the secretary of state, the attorney general, and the treasurer in the fourth, fifth, and sixth positions respectively. Provides for submission of the proposed amendment to the voters at the statewide election to be held Nov. 3, 2020. (Amends Const. Art.
