HOUSE BILL NO. 461
BY REPRESENTATIVE ZERINGUE
PROPERTY/PUBLIC:  Provides relative to a property exchange between the Department
of Wildlife and Fisheries and the United States Fish and Wildlife Service
1	AN ACT
2To authorize and provide for the exchange of certain state property; to authorize the
3 commissioner of administration and the secretary of the Department of Wildlife and
4 Fisheries to exchange certain state property in St. Mary Parish and West Feliciana
5 Parish with the United States Fish and Wildlife Service for property located in
6 Terrebonne Parish; to provide for the property descriptions; to provide for
7 reservation of mineral rights; to provide for terms and conditions; to provide an
8 effective date; and to provide for related matters.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  The commissioner of administration and the secretary of the Department
11of Wildlife and Fisheries, notwithstanding any other provision of law to the contrary, are
12hereby authorized and empowered to convey, transfer, assign, lease, or deliver any interest,
13excluding mineral rights, the state may have to all or any portion of the following described
14parcels of property to the United States Fish and Wildlife Service:
15 A certain tract or parcel of land, together with all of the buildings and
16 improvements thereon, situated in Section 33, T13S, R10E, SWD, Parish of
17 St. Mary, State of Louisiana and Being more particularly described as
18 follows:
19 Commence at the northwest point of said tract being NAD 1983 CORS96
20 State Plane Louisiana South coordinates X=3242147.16 Y=500937.07 thence
21 run in a easterly direction on a bearing of N 84º10'57" E a distance of 228.97'
22 to the northeast corner located at State Plane coordinates
23 X=3242374.96,Y=500960.28, thence in a southerly direction on a bearing of
24 S 02º11'36" E a distance of 140.78' to the southeast corner located at State
25 Plane coordinates X= 3242380.35, Y=500819.60, thence in a westerly

1 direction on a bearing of S 85º58'36" W a distance of 226.09' to to the
2 southwest corner located at State Plane coordinates X=3242154.82,
3 Y=500803.74, thence in a northerly direction on a bearing N 03º17'03" W a
4 distance of 133.55' to the point of beginning, said tract comprising of the
5 north 0.7 acres of the 3.0 acre tract being more particularly described on plat
6 entitled "Proposed Site Headquarters Attakapas Island Outdoor Recreation
7 Area" prepared by Louisiana Department of Public Works, Baton Rouge,
8 LA. dated Sept. 12, 1975 - File No. LS6-1C.
9 and
10 The fractional west half of Section 7 T3S-R3W of the Parish of West
11 Feliciana, State of Louisiana.
12 Section 2.  In exchange for the properties described in Section 1 of this Act, the
13commissioner of administration and the secretary of the Department of Wildlife and
14Fisheries are hereby authorized to accept from the United States Fish and Wildlife Service
15title to the following described parcel of property:
16 A certain tract of land situated in Section 66, T 17 S - R 16 E, Terrebonne
17 Parish, Louisiana, containing one (1) acre and being embraced within the
18 points "E-F-G-H-E", as shown on the "Map Showing Property to Be
19 Acquired in Sec. 66, T 17 S - R 16 E, by the Saint Anthony Broadcasting
20 Co., Shown by Letters A, B, C, D, and E, F, G, H, Located within
21 Terrebonne Parish, Louisiana", prepared by the office of T. Baker Smith &
22 Son, Inc., Civil & Consulting Engineers, Houma, Louisiana, approved by
23 Wm. Clifford Smith, C. E., dated February 1, 1971, a copy of which is
24 recorded at Entry Number 401446, Terrebonne Parish, which said tract is
25 more particularly described as follows:  Commence at Point E, which said
26 Point E is situated N 74

35 privileges and servitudes and appurtenances thereunto belonging or in

37 Section 3.  The commissioner of administration and the secretary of the Department
38of Wildlife and Fisheries are hereby authorized to enter into such agreements, covenants,
39conditions, and stipulations and to execute such documents as necessary to properly
40effectuate any conveyance, transfer, assignment, lease, or delivery of title, excluding mineral
41rights, to the property described in this Act, and as more specifically described in any such
42agreements entered into and documents executed by and between the commissioner of
43administration and the secretary of the Department of Wildlife and Fisheries and the United
44States Fish and Wildlife Service, in exchange of consideration proportionate to the appraised
45value of the property.

1 Section 4.  This Act shall become effective upon signature by the governor or, if not
2signed by the governor, upon expiration of the time for bills to become law without signature
3by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
4vetoed by the governor and subsequently approved by the legislature, this Act shall become
5effective on the day following such approval.

Authorizes the exchange of two parcels of land held by the Dept. of Wildlife and Fisheries,
one in the Attakapas Wildlife Management Area in St. Mary Parish and one that is an
inholding within the Cat Island National Wildlife Refuge in West Feliciana Parish for the
parcel of land upon which sits the Manadalay National Wildlife Refuge administrative office
in Terrebonne Parish.
Provides for the reservation of mineral rights to the state.
Effective upon signature of governor or lapse of time for gubernatorial action.
