HOUSE BILL NO. 47

PUBLIC BUILDINGS/GROUNDS:  Provides relative to authority of local governments to
name public buildings
1	AN ACT
2To amend and reenact R.S. 42:267(A), relative to naming of public buildings; to provide
3 relative to naming buildings in honor of living persons; and to provide for related
4 matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 42:267(A) is hereby amended and reenacted to read as follows:
7 ยง267.  Naming public state buildings, etc., in honor of a living person prohibited;
8	penalty
9	A.  Except as authorized or provided by law, no public building, public
10 bridge, public park, public fish or game preserve, or public wildlife refuge owned by
11 the state or by any political subdivision of the state or by any institution receiving its
12 support in whole or in part from the state shall be named in honor of any living
13 person.

15 Section 2.  This Act shall take effect and become operative if and when the proposed
16amendment of Article VI of the Constitution of Louisiana contained in the Act which
17originated as House Bill No.       of this 2020 Regular Session of the Legislature is adopted
18at a statewide election and becomes effective.

Abstract:  Exempts local governments from the prohibition on naming public buildings
after living persons.
Present law prohibits the naming of a public building or certain other public facilities owned
by the state, by a local government, or by an institution receiving support from the state in
honor of a living person.
Proposed constitutional amendment (HB     ) authorizes the governing authority of a local
government to name a building or facility it owns after any living or deceased person.
Proposed law exempts local governments from the prohibition in present law.
Effective if and when the proposed amendment of Article VI of the Constitution of La.
contained in the Act which originated as House Bill No.       of this 2020 R.S. of the
Legislature is adopted at a statewide election and becomes effective.
