PURCHASING/PROCUREMT CD:  Provides relative to technology procurement
1	AN ACT
2To enact R.S. 39:199.1, relative to technology procurement; to authorize alternative
3 procedures for procurement of certain technology; to provide limitations and
4 requirements; to provide relative to the duties and authority of the Joint Legislative
5 Committee on Technology and Cybersecurity and the Joint Legislative Committee
6 on the Budget; and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 39:199.1 is hereby enacted to read as follows: 
9 ยง199.1.  Alternative procedures
10	Notwithstanding any provision of law to the contrary, an agency shall not be
11 required to follow the procedures provided in this Part or the Louisiana Procurement
12 Code for procurement of software and the hardware used to support the software if
13 the alternative procedures to be used by the agency are approved by the Joint
14 Legislative Committee on Technology and Cybersecurity and the specific
15 procurement is approved by the Joint Legislative Committee on the Budget.
16 Section 2.  This Act shall take effect and become operative if and when the Act
17which originated as House Bill No. 636 of this 2020 Regular Session of the Legislature is
18enacted and becomes effective.

Abstract:  Authorizes an agency to procure certain technology using alternative procedures
if approved by the Joint Legislative Committee on Technology and Cybersecurity
and the Joint Legislative Committee on the Budget.
Present law (R.S. 39:196 et seq.) provides procedures and requirements for agencies in the
executive branch of state government (other than agencies headed by a statewide elected
official) to use for the purchase, lease, and rental of information technology equipment,
related services, and software.  Present law (R.S. 39:1551 et seq.) provides procedures and
requirements for state procurement.
Proposed law retains present law and additionally provides that an agency shall not be
required to follow the procedures provided in present law for procurement of software and
the hardware used to support the software if the alternative procedures to be used by the
agency are approved by the Jt. Legislative Committee on Technology and Cybersecurity and
the specific procurement is approved by the Jt. Legislative Committee on the Budget.
Effective if and when House Bill No. 636 of this 2020 R.S. is enacted and becomes effective.
