HOUSE BILL NO. 484

WEAPONS:  Provides an exception to certain offenses of illegal carrying of weapons for
persons with a concealed handgun permit
1	AN ACT
2To amend and reenact R.S. 14:95(A)(1), (2), and (3), relative to the illegal carrying of
3 weapons; to provide relative to the prohibition on the concealed carrying of any
4 firearm or other instrumentality customarily used or intended for use as a dangerous
5 weapon; to provide an exception to the offense for a concealed handgun permit
6 holder; and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 14:95(A)(1), (2), and (3) are hereby amended and reenacted to read
9as follows: 
10 ยง95.  Illegal carrying of weapons
11	A.  Illegal carrying of weapons is any of the following:
12	(1)(a)  The intentional concealment of any firearm, or other instrumentality
13 customarily used or intended for probable use as a dangerous weapon, on one's
14 person; or.
15	(b)  The provisions of this Paragraph shall not apply to a person with a valid
16 concealed handgun permit issued pursuant to R.S. 40:1379.1.1, 1379.3, or 1379.3.2
17 nor shall it prohibit a person with a valid concealed handgun permit issued pursuant
18 to R.S. 40:1379.1.1, 1379.3, or 1379.3.2 from carrying a concealed firearm or other
19 instrumentality customarily used or intended for probable use as a dangerous weapon
20 on his person unless otherwise prohibited by this Section.

1	(2)  The ownership, possession, custody or use of any firearm, or other
2 instrumentality customarily used as a dangerous weapon, at any time by an enemy
3 alien; or.
4	(3)  The ownership, possession, custody or use of any tools, or dynamite, or
5 nitroglycerine, or explosives, or other instrumentality customarily used by thieves
6 or burglars at any time by any person with the intent to commit a crime; or.

Abstract:  Provides an exception to certain offenses of illegal carrying of weapons for
persons with a concealed handgun permit.
Present law provides that the illegal carrying of weapons is any of the following and
provides criminal penalties for those who are convicted of the offense:
(1)The intentional concealment of any firearm, or other instrumentality customarily
used or intended for probable use as a dangerous weapon, on one's person.
(2)The ownership, possession, custody or use of any firearm, or other instrumentality
customarily used as a dangerous weapon, at any time by an enemy alien.
(3)The ownership, possession, custody or use of any tools, or dynamite, or
nitroglycerine, or explosives, or other instrumentality customarily used by thieves
or burglars at any time by any person with the intent to commit a crime.
(4)The intentional concealment on one's person of any switchblade knife, spring knife,
or other knife or similar instrument having a blade which may be automatically
unfolded or extended from a handle by the manipulation of a button, switch, latch,
or similar contrivance located on the handle.  Present law provides certain exceptions
to this prohibition.  
(5)The intentional possession or use by any person of a dangerous weapon on a school
campus during regular school hours or on a school bus. Present law provides certain
exceptions to this prohibition.  
Proposed law retains present law but provides an exception to the prohibition described in
Paragraph (1) above for any person who has a valid concealed handgun permit issued
pursuant to present law (R.S. 40:1379.1.1, 1379.3, and 1379.3.2).  Proposed law further
provides that the provisions of Paragraph (1) described above shall not prohibit a person with
a valid concealed handgun permit issued pursuant to present law from carrying a concealed
firearm or other instrumentality customarily used or intended for probable use as a
dangerous weapon on his person unless otherwise prohibited by present law.
