HOUSE BILL NO. 640

DISTRICTS/WATERWORKS:  Provides with respect to the salary of waterworks
commissioners
1	AN ACT
2To amend and reenact R.S. 33:3819(A) and to repeal R.S. 33:3819(B) through (L), relative
3 to waterworks districts; to provide relative to the per diem paid to members of the
4 board of commissioners; to delete general limitations relative to per diem paid to
5 board members; to repeal provisions relative to certain waterworks districts with
6 respect to the per diem paid to board members; and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 33:3819(A) is hereby amended and reenacted to read as follows:
9 ยง3819.  Meetings of commissioners; meeting place; absences; compensation
10	A.  The commissioners of each waterworks district may meet as often as
11 necessary, but shall meet at least once every three months.  The board of waterworks
12 commissioners by resolution shall designate a regular meeting place for the holding
13 of its meetings, which shall be held at a place located within the waterworks district
14 or at the parish seat of the parish in which the district is located, even though the
15 parish seat is not within the boundaries of the waterworks district.  The absence of
16 a commissioner from any four consecutive meetings shall be deemed to create a
17 vacancy and it shall be filled by the police jury, if the commissioner had been
18 appointed by the police jury, or by appointment of the governing authority of a
19 municipality included in the district, if the commissioner had been appointed by the
20 said governing authority.  The parish governing authority in the parish in which each

1 waterworks district is located may fix the and pay a per diem to be paid to each of
2 the members of the board of commissioners of the respective waterworks districts
3 in an amount not to exceed sixty dollars for each meeting they attend, up to and
4 including twenty-four meetings in each year and for each special meeting not to
5 exceed twelve special meetings in each year.  Per diem provided by this Section shall
6 be paid out of the district funds in the hands of the treasurer; however, no elected
7 official serving as a member of the board of commissioners shall receive any per
8 diem for attending meetings of the board.

10 Section 2.  R.S. 33:3819(B) through (L) are hereby repealed in their entirety.

Abstract:  Deletes general limitations relative to per diem paid to members of the board of
commissioners of waterworks districts and repeals provisions relative to certain
waterworks districts with respect to the per diem paid to board members.
Present law authorizes parishes to create waterworks districts, which have control of water
systems in their respective districts.  Provides for meetings of the board of commissioners
of any such district.
Present law authorizes a per diem of up to $60 for waterworks district commissioners for
attendance of meetings for up to 24 regular meetings and 12 special meetings each year. 
Proposed law deletes present law per diem limitations for waterworks districts.
Present law provides for higher limits on per diem for particular districts and parishes. 
Proposed law repeals these particular provisions in accordance with proposed law removing
the general limits.
