HOUSE BILL NO. 641

ETHICS:  Allows public employees of a political subdivision that operates parks and
recreational facilities to rent facilities at a discounted rate subject to certain
conditions
1	AN ACT
2To amend and reenact R.S. 42:1123(44), relative to ethics; to provide an exception from
3 ethics laws to allow certain public employees of a political subdivision that operates
4 parks and recreation facilities to rent park facilities at a discounted rate under certain
5 conditions; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 44:1123(44) is hereby amended and reenacted to read as follows:
8 ยง1123.  Exceptions
9	This Part shall not preclude:

11	(44)(a)  A An immediate family member of a governing authority member
12 or public employee of a political subdivision that operates parks or recreational
13 facilities or an immediate family member of such a person from renting a park or
14 recreation facility under the supervision or jurisdiction of the political subdivision
15 for an event provided that the transaction is conducted without preference and in the
16 same manner and subject to the same fees and conditions applicable to the general
17 public.
18	(b)  A governing authority member of a political subdivision that operates
19 parks or recreational facilities from renting a park or recreation facility under the

1 supervision or jurisdiction of the political subdivision for an event provided that the
2 transaction is conducted without preference and in the same manner and subject to
3 the same fees and conditions applicable to the general public.
4	(c)  A public employee, excluding any appointed board or commission
5 member, of a political subdivision that operates parks or recreational facilities from
6 renting a park or recreation facility under the supervision or jurisdiction of the
7 political subdivision for an event at a discounted fee or rate provided that the
8 transaction is conducted without preference and in the same manner and subject to
9 the same conditions applicable to the general public.

Abstract:  Allows a public employee of a political subdivision that operates parks or
recreational facilities to rent a park facility for an event at a discounted rate or fee
provided that the transaction is conducted without preference and in the same manner
and subject to the same conditions applicable to the general public.
Present law (R.S. 42:1113(A) and (B) - ethics code) prohibits a public servant or his
immediate family member from entering into a transaction under the supervision or
jurisdiction of the agency of the public servant and further prohibits an appointed board or
commission member or a member of his immediate family from entering into or being in
anyway interested in a transaction under the supervision or jurisdiction of the board or
commission.  Present law provides certain exceptions.
Present law provides an exception to allow a governing authority member or public
employee of a political subdivision that operates parks or recreational facilities or an
immediate family member of such a person to rent a park or recreation facility under the
supervision or jurisdiction of the political subdivision for an event provided that the
transaction is conducted without preference and in the same manner and subject to the same
fees and conditions applicable to the general public.
Proposed law retains present law relative to governing authority members and immediate
family members, but provides an additional exception to allow an public employee,
excluding an appointed board or commission member, of a political subdivision that operates
parks or recreational facilities to rent a park or recreation facility under the supervision or
jurisdiction of the political subdivision for an event at a discounted rate or fee provided that
the transaction is conducted without preference and in the same manner and subject to the
same conditions applicable to the general public.
