PUBLIC RECORDS: Provides relative to interagency data sharing
1 AN ACT
2To enact Chapter 15-A of Title 49 of the Louisiana Revised Statutes of 1950, to be
3 comprised of R.S. 49:1061, relative to interagency data sharing; to provide for a data
4 sharing review board; to provide for data sharing authorization; and to provide for
5 related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1. Chapter 15-A of Title 49 of the Louisiana Revised Statutes of 1950,
8comprised of R.S. 49:1061, is hereby enacted to read as follows:
9 CHAPTER 15-A. DATA SHARING REVIEW
10 ยง1061. Data sharing review
11 A. A state agency requesting data from another state agency may petition the
12 joint committee on governmental affairs to conduct a review of the agency's request
13 for data sharing to gain authorization by the committee for the data to be shared
14 between the agencies.
15 B.(1) The requesting agency shall send a petition in writing to both the
16 House and Senate committees on governmental affairs. The request shall include the
17 following information:
18 (a) The receiving or requesting agency and the disclosing agency.
19 (b) Scope of data being requested.
20 (c) Scope of use, including who will have access to the data.

1 (d) Method of transfer.
2 (e) Legal authority for the transfer.
3 (2)(a) Upon receipt of the agency's petition, the joint committee on
4 governmental affairs may conduct a hearing to approve the agency's request for the
5 data to be shared.
6 (b) The joint committee on governmental affairs shall notify the agencies of
7 the scope of the public meeting regarding the agency's request for data.
8 C.(1) Each state agency shall cooperate with the House and Senate
9 committees on governmental affairs in fulfilling the requirements of this section.
10 (2) Upon the approval by the joint committee on governmental affairs of the
11 agency's request for data, the disclosing agency shall be authorized to provide the
12 data to the requesting agency.
