HOUSE BILL NO. 772

PROCUREMENT:  Requires purchase from Louisiana vendors in certain circumstances
1	AN ACT
2To enact R.S. 39:1702(D), relative to public procurement; to provide restrictions on
3 cooperative purchasing; to provide definitions; and to provide for related matters.
4Be it enacted by the Legislature of Louisiana:
5 Section 1.  R.S. 39:1702(D) is hereby enacted to read as follows: 
6 ยง1702.  Cooperative purchasing authorized; participation in federal General Services
7	Administration vendor list

9	D.  Notwithstanding any provision of this Section to the contrary, no use shall
10 be made of federal General Services Administration supply schedules under the
11 provisions of this Section if the good is available in sufficient quantity and at a
12 comparable price from a Louisiana-based vendor with an existing state contract.  For
13 the purposes of this Section, the term "comparable price" shall mean a price no more
14 than ten percent in excess of the price offered by any Louisiana-licensed dealer or
15 distributor for that same good on the General Services Administration supply
16 schedule.
17 Section 2.  This Act shall become effective upon signature by the governor or, if not
18signed by the governor, upon expiration of the time for bills to become law without signature
19by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If

1vetoed by the governor and subsequently approved by the legislature, this Act shall become
2effective on the day following such approval.

Abstract:  Requires purchase from Louisiana-based vendors rather than from the federal
government's supply schedules in certain circumstances.
Present law authorizes public purchasers and certain other parties to utilize the federal
government's supply schedules to obtain greater savings by leveraging the federal
government's generally larger purchasing power.  Limits such purchases to only those
involving a Louisiana-licensed dealer or distributor of the good.  Proposed law retains
present law.
Proposed law prohibits use of the federal supply schedules to purchase a good when the good
is available in sufficient quantity and at a "comparable price" from a Louisiana-based vendor
with an existing state procurement contract.
Defines "comparable price" to mean a price no more than 10% above the price offered by
any Louisiana-licensed dealer or distributor for that same good on the General Services
Administration  supply schedule.
Effective upon signature of governor or lapse of time for gubernatorial action.
