HLS 20RS-374 ORIGINAL 2020 Regular Session HOUSE BILL NO. 81 BY REPRESENTATIVE TURNER ETHICS/NEPOTISM: Provides an exception to allow immediate family members of a coach of a collegiate athletic program to be employed on the staff of that program 1 AN ACT 2To enact R.S. 42:1119(I), relative to nepotism; to provide an exception to allow an 3 immediate family member of a coach of an athletic program at a public higher 4 education institution to be employed on the staff of that program; and to provide for 5 related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 42:1119(I) is hereby enacted to read as follows: 8 ยง1119. Nepotism 9 * * * 10 I. Nothing in this Section shall prohibit the employment of an immediate 11 family member of a coach of an athletic program at a public higher education 12 institution on the staff of that program nor shall the provisions of this Section be 13 construed to hinder, alter, or in any way affect normal promotional advancements for 14 such an immediate family member. 15 Section 2. This Act shall become effective upon signature by the governor or, if not 16signed by the governor, upon expiration of the time for bills to become law without signature 17by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 18vetoed by the governor and subsequently approved by the legislature, this Act shall become 19effective on the day following such approval. Present law (ethics code) generally prohibits an immediate family member of an agency head from being employed in his agency, but present law has a general exception to allow the continued employment of an immediate family member of an agency head if the public employee has been employed in the agency for a period of at least one year prior to the public employee's immediate family member becoming the agency head. Present law contains additional, more specific exceptions. Proposed law retains present law and provides an additional exception to allow an immediate family member of a coach of an athletic program at public higher education institution to be employed on the staff of that program and to receive normal promotional advancements. Effective upon signature of governor or lapse of time for gubernatorial action.
