Existing law requires the Dept. of Environmental Quality to conduct hearings on
environmental assessment statements.  Simultaneously with the submission of the statement
to the department, requires the applicant to submit copies of the assessment statement to the
local governmental authority or the designated public library.
New law requires placement of the assessment statement in a designated public building
where the facility is located.
Prior law, relative to solid waste permits, prohibited the secretary of the Dept. of
Environmental Quality from issuing any permit or promulgating any regulation that would
allow the operation of a medical waste incinerator disposal facility until authorized by law.
Grandfathered facilities with permits or applications prior to July 1, 1990.  New law repealed
prior law.
Existing law requires notification to legislators in the area of the site facility prior to issuance
of a permit.  New law retains existing law.  Prior law required the department to promulgate
regulations within 180 days after being authorized to do so.  New law removes the 180-day
time period.
New law authorizes the secretary to issue a permit for medical waste facilities only in
parishes with a population less than 50,000 according to the latest decennial census.
Existing law provides for the secretary's authority to permit commercial hazardous waste
incineration facilities.  Existing law exempts medical waste incinerators from that authority.
New law retains existing law.
Effective June 9, 2020.
