HLS 20RS-448 REENGROSSED 2020 Regular Session HOUSE CONCURRENT RESOL UTION NO. 48 BY REPRESENTATIVE WRIGHT ADMINISTRATIVE PROCEDURE: Requests the House and Senate governmental affairs committees to meet and function as a joint committee to review the process of rulemaking by state agencies and the Louisiana Administrative Code and make recommendations relative thereto 1 A CONCURRENT RESOL UTION 2To urge and request the House Committee on House and Governmental Affairs and the 3 Senate Committee on Senate and Governmental Affairs to meet and function as a 4 joint committee to study and make recommendations regarding all issues related to 5 the process of rulemaking by state agencies and the existing Louisiana 6 Administrative Code. 7 WHEREAS, rulemaking is an important factor in the orderly operation of programs 8and for ensuring that legislative intent in creating policies and programs is effectively 9administered; and 10 WHEREAS, unless regularly reviewed and revised, rules and regulations may 11become outdated or overly burdensome and in some instances may no longer reflect the 12current state of the law; and 13 WHEREAS, because administrative rules affect every Louisiana citizen and 14business, it is vital to ensure that rules and regulations are necessary and not burdensome; 15and 16 WHEREAS, it is important to systematically review rules and regulations and the 17rulemaking process to ensure that government is reasonable and accountable to its citizens. 18 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 19urge and request the House Committee on House and Governmental Affairs and the Senate 20Committee on Senate and Governmental Affairs to meet and function as a joint committee Page 1 of 3 HLS 20RS-448 REENGROSSED HCR NO. 48 1to study and make recommendations regarding all issues related to the process of rulemaking 2by state agencies and the existing Louisiana Administrative Code. 3 BE IT FURTHER RESOLVED that the joint committee shall solicit the input, 4recommendations, and advice of the following: 5 (1) The chairman of the House Committee on Appropriations, or his designee. 6 (2) The chairman of the Senate Committee on Finance, or his designee. 7 (3) The chairman of the Senate Committee on Health and Welfare, or his designee. 8 (4) The chairman of the House Committee on Health and Welfare, or his designee. 9 (5) The chairman of the House Committee on Commerce, or his designee. 10 (6) The chairman of the Senate Committee on Commerce, Consumer Protection and 11International Affairs, or his designee. 12 (7) The Louisiana Association of Business and Industry. 13 (8) The Pelican Institute. 14 (9) The National Federation of Independent Businesses. 15 (10) The Louisiana Chemical Association. 16 (11) The Louisiana Oil and Gas Association. 17 (12) The Louisiana AFL-CIO. 18 (13) The Louisiana Association of Nonprofit Organizations. 19 (14) The Society of Louisiana Certified Public Accountants. 20 (15) The Louisiana REALTORS Association. 21 (16) The Louisiana Industrial Development Executives Association. 22 (17) Any other person or organization the joint committee deems appropriate. 23 BE IT FURTHER RESOLVED that in conducting such study, the joint committee 24may study and compare rulemaking practices of other states and of the federal government 25to identify best practices. 26 BE IT FURTHER RESOLVED that the joint committee may conduct meetings at 27times it deems necessary or convenient to enable it to exercise fully and effectively its 28powers, perform its duties, and accomplish the objectives and purposes of this Resolution. 29 BE IT FURTHER RESOLVED that the joint committee shall make a report of its 30findings and recommendations, with suggestions for proposed legislation, if any, to the Page 2 of 3 HLS 20RS-448 REENGROSSED HCR NO. 48 1legislature no later than thirty days prior to the convening of the 2021 Regular Session of the 2Legislature.
