ENROLLED 2020 Regular Session HOUSE CONCURRENT RESOL UTION NO. 48 BY REPRESENTATIVE WRIGHT A CONCURRENT RESOL UTION To urge and request the House Committee on House and Governmental Affairs and the Senate Committee on Senate and Governmental Affairs to meet and function as a joint committee to study and make recommendations regarding all issues related to the process of rulemaking by state agencies and the existing Louisiana Administrative Code. WHEREAS, rulemaking is an important factor in the orderly operation of programs and for ensuring that legislative intent in creating policies and programs is effectively administered; and WHEREAS, unless regularly reviewed and revised, rules and regulations may become outdated or overly burdensome and in some instances may no longer reflect the current state of the law; and WHEREAS, because administrative rules affect every Louisiana citizen and business, it is vital to ensure that rules and regulations are necessary and not burdensome; and WHEREAS, it is important to systematically review rules and regulations and the rulemaking process to ensure that government is reasonable and accountable to its citizens. THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby urge and request the House Committee on House and Governmental Affairs and the Senate Committee on Senate and Governmental Affairs to meet and function as a joint committee to study and make recommendations regarding all issues related to the process of rulemaking by state agencies and the existing Louisiana Administrative Code. BE IT FURTHER RESOLVED that the joint committee shall solicit the input, recommendations, and advice of the following: (1) The chairman of the House Committee on Appropriations, or his designee. (2) The chairman of the Senate Committee on Finance, or his designee. Page 1 of 2 HCR NO. 48 ENROLLED (3) The chairman of the Senate Committee on Health and Welfare, or his designee. (4) The chairman of the House Committee on Health and Welfare, or his designee. (5) The chairman of the House Committee on Commerce, or his designee. (6) The chairman of the Senate Committee on Commerce, Consumer Protection and International Affairs, or his designee. (7) The Louisiana Association of Business and Industry. (8) The Pelican Institute. (9) The National Federation of Independent Businesses. (10) The Louisiana Chemical Association. (11) The Louisiana Oil and Gas Association. (12) The Louisiana AFL-CIO. (13) The Louisiana Association of Nonprofit Organizations. (14) The Society of Louisiana Certified Public Accountants. (15) The Louisiana REALTORS Association. (16) The Louisiana Industrial Development Executives Association. (17) Any other person or organization the joint committee deems appropriate. BE IT FURTHER RESOLVED that in conducting such study, the joint committee may study and compare rulemaking practices of other states and of the federal government to identify best practices. BE IT FURTHER RESOLVED that the joint committee may conduct meetings at times it deems necessary or convenient to enable it to exercise fully and effectively its powers, perform its duties, and accomplish the objectives and purposes of this Resolution. BE IT FURTHER RESOLVED that the joint committee shall make a report of its findings and recommendations, with suggestions for proposed legislation, if any, to the legislature no later than thirty days prior to the convening of the 2021 Regular Session of the Legislature.
