HOUSE CONCURRENT RESOL UTION NO. 98
BY REPRESENTATIVE LYONS
MEDICAID MANAGED CARE:  Request the La. Department of Health to implement
certain reforms in the nonemergency, non-ambulance medical transportation
component of the Medicaid managed care program
1	A CONCURRENT RESOL UTION
2To urge and request the Louisiana Department of Health to implement certain reforms in the
3 nonemergency, non-ambulance medical transportation component of the Medicaid
4 managed care program of this state.
5 WHEREAS, nonemergency, non-ambulance medical transportation (NEMT) is a
6vital component of the Medicaid program of this state; and
7 WHEREAS, through NEMT, Medicaid enrollees access primary care providers,
8pharmacy services, and other forms of health services that help them to maintain and
9improve their health; and
10 WHEREAS, reforms and innovations in the way that NEMT services are delivered
11through the Medicaid managed care program of this state are necessary in order to better
12serve Medicaid enrollees and to improve the program overall.
13 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
14urge and request the Louisiana Department of Health to require that in any contract with a
15Medicaid managed care organization (MCO) with an effective date of January 1, 2022, or
16after, the MCO shall utilize a transportation broker which has a Louisiana-based call center.
17 BE IT FURTHER RESOLVED that in order to ensure fair competition among
18providers on a regional basis, the legislature does hereby urge and request the Louisiana
19Department of Health, through its contracts with MCOs, to prohibit an out-of-region
20nonemergency, non-ambulance medical transportation provider from providing services to

1a Medicaid enrollee if there is a willing and available nonemergency, non-ambulance
2medical transportation provider in the region where the Medicaid enrollee is domiciled.
3 BE IT FURTHER RESOLVED that in order to foster quality improvement in its
4Medicaid NEMT program, LDH may partner or otherwise enter into a formal relationship
5with an association to accomplish the following:
6 (1)  Promote uniformity in the nonemergency, non-ambulance medical transportation
7industry.
8 (2)  Set standards that elevate quality and promote trusted service.
9 (3)  Provide opportunities for training and business counseling.
10 (4)  Maintain a vetted, updated list of active nonemergency, non-ambulance medical
11transportation providers.
12 (5)  Develop a platform for all who work within the nonemergency, non-ambulance
13medical transportation industry or utilize nonemergency medical transportation services to
14receive the latest news and trends affecting the nonemergency, non-ambulance medical
15transportation  industry.
16 BE IT FURTHER RESOLVED that the Louisiana Department of Health is hereby
17authorized to promulgate any administrative rules as are necessary to implement the
18provisions of this Resolution.
19 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
20secretary of the Louisiana Department of Health and the executive director of the Louisiana
21Medicaid Managed Care Organization Association.
