SENATE BILL NO. 131

TAX/LOCAL.  Provides relative to cooperative local government incentives. (gov sig)
1	AN ACT
2 To amend and reenact R.S. 33:7632 and 7633(A), relative to local tax incentives; to provide
3 for purpose and applicability; to provide for cooperative endeavor agreements
4 relative to the incentives; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 33:7632 and 7633(A) are hereby amended and reenacted to read as
7 follows:
8 §7632. Declaration of purpose; applicability
9	A. The legislature hereby finds and declares that the health, safety, and
10 welfare of the people of this state are dependent upon the continued encouragement,
11 development, growth, and expansion of private sector economic development within
12 the state. The legislature further finds and declares that there are certain depressed
13 areas in the state that need the particular attention of government. These depressed
14 areas often have declining or minimal tax revenues creating a widening gap in
15 funding between the costs of public project needs and available resources at the local
16 level to address them. Finally, investment in public infrastructure projects could
17 dramatically improve the quality of life of residents and make the areas more

1 attractive to private sector economic development. Therefore, it is declared to be the
2 purpose of this Chapter to stimulate a partnership between government and the
3 private sector for business growth in these depressed areas through local incentives
4 for private sector donations for local public infrastructure projects.
5	B. This Chapter shall apply only to cooperative endeavor agreements or
6 programs developed by local governments which expressly cite this Chapter as
7 authority for the agreement, and shall not be construed as being applicable or
8 otherwise limit a local government entity to enter into cooperative endeavor
9 agreements generally.
10 §7633. Cooperative endeavor agreements
11	A.(1) As authorized by Article VII, Section 14(C) of the Louisiana
12 Constitution, political subdivisions and political corporations may enter into a
13 cooperative endeavor agreement with any public or private association, corporation,
14 or individual to carry out a local infrastructure project to achieve a public purpose.
15 Any capital improvements shall be on public property and for local infrastructure
16 projects as authorized in this Chapter.

18 Section 2.  This Act shall become effective upon signature by the governor or, if not
19 signed by the governor, upon expiration of the time for bills to become law without signature
20 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
21 vetoed by the governor and subsequently approved by the legislature, this Act shall become
22 effective on the day following such approval.

Present law authorizes political subdivisions to enter into cooperative endeavor agreements
with private entities under which the private entity donates cash, equipment, goods, or
services to local infrastructure projects.
Proposed law retains present law but removes the qualification that the public project be an
infrastructure project.
