SENATE BILL NO. 152

PHYSICIANS.  Prohibits the restraint of the practice of medicine in contracts or agreements.

1	AN ACT
2 To enact R.S. 23:922, relative to a prohibition on the restraint of the practice of medicine in
3 contracts or agreements; and to provide for related matters.
4 Be it enacted by the Legislature of Louisiana:
5 Section 1.  R.S. 23:922 is hereby enacted to read as follows:
6 ยง922. Restraint on the practice of medicine prohibited
7	A. Notwithstanding any provision of law to the contrary, no contract,
8 agreement, or provision thereof shall be enforceable to restrict a physician from
9 the practice of medicine following the termination of any employment or
10 independent contractor agreement.
11	B. For purposes of this Section, "physician" has the same meaning as
12 provided for in R.S. 37:1262.

agreements, or provisions that prevent the physician from practicing following the

termination of any employment or independent contractor agreement. Proposed law defines
physician as a natural person who is the holder of an allopathic (M.D.) degree or an
osteopathic (D.O.) degree from a medical college in good standing with the La. State Board
of Medical Examiners who holds a license, permit, certification, or registration issued by the
board to engage in the practice of medicine in this state. Doctors of allopathic medicine
(M.D.) and doctors of osteopathic medicine (D.O.) shall be accorded equal professional
status and unrestricted privileges in the practice of medicine.
