SENATE BILL NO. 162
BY SENATOR HENSGENS 
WILDLIFE/FISHERIES DEPT.  Authorizes the acceptance of alternative proof of residency
for certain applicants for hunting. (8/1/20)
1	AN ACT
2 To amend and reenact R.S. 56:8(16)(a)(ii) and (b)(i), and to enact R.S. 56:8(16)(a)(v),
3 relative to the definition of bona fide resident; to provide for alternative forms of
4 proof of residency; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 56:8(16)(a)(ii) and (b)(i) are hereby amended and reenacted and R.S.
7 56:8(16)(a)(v) is hereby enacted to read as follows:
8 ยง8.  Definitions
9	For purposes of this Chapter, the following words and phrases have the
10 meaning ascribed to them in this Section, unless the context clearly shows a different
11 meaning:

13	(16)(a)  Except as specified in Subparagraph (b) of this Paragraph, "bona fide
14 resident" means any person who is a United States citizen or resident alien and has
15 resided in this state continuously during the twelve months immediately prior to the
16 date on which he applies for any license and who has manifested his intent to remain
17 in this state by establishing Louisiana as his legal domicile, as demonstrated by

1 compliance with all of the following, as applicable:

3	(ii)  If licensed to drive a motor vehicle, he is in possession of a Louisiana
4 driver's license, or, if over the age of fifteen years and not licensed to drive, he is in
5 possession of a special identification card issued by the Department of Public Safety
6 and Corrections under the provisions of R.S. 40:1321 an alternative form of proof
7 of residency that the department deems acceptable.

9	(v) If a minor who cannot otherwise demonstrate legal domicile by other
10 methods established in this paragraph, he is in possession of an alternative form
11 of proof of residency that the department deems acceptable.
12	(b)  For purchase of a license for hunting or recreational fishing activities
13 where such license does not authorize any commercial activity, "bona fide resident"
14 means the following:
15	(i)  Any person who is a United States citizen or resident alien and has
16 resided in this state continuously during the six months immediately prior to the date
17 on which he applies for any such license and who has manifested his intent to remain
18 in this state by establishing Louisiana as his legal domicile, as demonstrated by
19 compliance with Items (a)(i) through (iv) (v) of this Paragraph.

Present law requires anyone over the age of 15 years not licensed to drive to present a
special identification card issued by the Department of Public Safety and Corrections as
proof of residency in order to obtain any license.
Proposed law requires anyone not licensed to drive to present any form of identification that
the Dept. of Wildlife and Fisheries deems acceptable as proof of residency in order to obtain
any license.
Proposed law further allows minors who cannot otherwise demonstrate legal domicile by

other methods established in present law to present any form of identification that the Dept.
of Wildlife and Fisheries deems acceptable as proof of residency in order to obtain any
