SENATE BILL NO. 253

ANIMALS.  Prohibits the raffle or giving away of certain animals as a novelty or prize at
a carnival or fair. (8/1/20)
1	AN ACT
2 To enact R.S. 3:2363.1, relative to the raffle of certain animals; to prohibit raffling or giving
3 away certain animals as a novelty or prize at a carnival or fair; to provide for
4 exemptions; to provide for a penalty; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 3:2363.1 is hereby enacted to read as follows:
7 ยง2363.1.  Raffle of animals as novelties or prizes prohibited; exemptions;
8	penalty
9	A.  No person, firm, or corporation shall raffle or give away any animal
10 as a novelty or prize at a carnival or fair.
11	B.  For purposes of this Section, the term "animal" shall mean chickens,
12 ducks, iguanas, pot bellied pigs, rabbits, reptiles, fish, birds, and turtles.
13	C. Nothing in this Section shall prohibit a humane society, animal
14 shelter, or a pet shop from caring for, adopting, or selling animals as pets.
15	D.  Nothing in this Section shall prohibit a hunting club from raffling
16 hunting dogs.
17	E.  Any person, firm, or corporation convicted in a court of competent

1 jurisdiction of violating the provisions of this Section shall be subject to a fine
2 of not more than one hundred dollars per violation. Each day on which a
3 violation occurs shall constitute a separate offense.

Proposed law prohibits raffling or giving away any animal as a novelty or prize at a carnival
or fair.
Proposed law defines the term "animal" as chickens, ducks, iguanas, pot bellied pigs, rabbits,
reptiles, fish, birds, and turtles.
Proposed law exempts a humane society, animal shelter, or a pet shop from caring for,
adopting, or selling animals as pets from the provisions of proposed law.
Proposed law exempts hunting clubs that raffle hunting dogs from the provisions of
proposed law.
Proposed law subjects any person, firm, or corporation convicted in a court of competent
jurisdiction of violating the provisions of proposed law to a fine of not more than $100 per
violation. Each day on which a violation occurs constitutes a separate offense. 
Effective August 1, 2020.
