SENATE BILL NO. 27

SPECIAL DISTRICTS.  Provides relative to the powers and duties of the Harbor Center

1	AN ACT
2 To amend and reenact R.S. 33:4575.3(20)(a), relative to the Harbor Center District; to
3 provide for the powers and duties of the district; and to provide for related matters.
4	Notice of intention to introduce this Act has been published.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 33:4575.3(20)(a) is hereby amended and reenacted to read as
7 follows:
8 ยง4575.3. Powers and duties
9	The board shall have all powers necessary or convenient to effectuate the
10 purposes of the district, including but not limited to the following rights and powers:

12	(20)(a) To With the approval of the State Bond Commission, to levy a tax
13 based upon the occupancy of hotel rooms, motel rooms, and overnight camping
14 facilities within the district in order to provide funds for the operation of the district,
15 including the construction, acquisition, development, maintenance, repair,
16 reconstruction, refurbishment, renovation, operation of or administration of any
17 facility owned, or to be owned or operated by the district and the acquisition,

1 construction repair or replacement of machinery, equipment, and furnishings. The
2 tax shall not exceed two dollars per occupant day.

4 Section 2.  This Act shall become effective upon signature by the governor or, if not
5 signed by the governor, upon expiration of the time for bills to become law without signature
6 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
7 vetoed by the governor and subsequently approved by the legislature, this Act shall become
8 effective on the day following such approval.

Present law provides for the board of the Harbor Center District to levy a tax based upon the
occupancy of hotel rooms, motel rooms, and overnight camping facilities within the district,
with the approval of the State Bond Commission, in order to provide funds for the operation
of the district, including the construction, acquisition, development, maintenance, repair,
reconstruction, refurbishment, renovation, operation of or administration of any facility
owned, or to be owned or operated by the district and the acquisition, construction repair or
replacement of machinery, equipment, and furnishings. The tax shall not exceed two dollars
per occupant day.
Proposed law retains present law but removes the requirement that the State Bond
Commission must approve the levying of the tax. 
Effective upon signature of the governor or lapse of time for gubernatorial action.
