(gov sig) 1 AN ACT 2 To amend and reenact R.S. 33:4575.1(A)(5), (6), (10), and (12), and 4575.3(20)(a), relative 3 to the Harbor Center District; to provide for the board of commissioner 4 appointments; to provide for the powers and duties of the district; and to provide for 5 related matters. 6 Notice of intention to introduce this Act has been published. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 33:4575.1(A)(5), (6), (10), and (12), and 4575.3(20)(a) are hereby 9 amended and reenacted to read as follows: 10 §4575.1. Board of commissioners; appointment; terms; vacancies 11 A. The control and management of the affairs of the district shall be vested 12 in a board of commissioners that is hereby created. The board shall consist of 13 fourteen members charged with administering the business and recreational and 14 cultural events and programs undertaken by the district. Except for the executive 15 director of the St. Tammany Parish Tourist and Convention Commission, all 16 members of the commission shall be qualified voters and residents of Ward Eight or 17 Ward Nine of St. Tammany Parish. SB NO. 27 SLS 20RS-3 ENGROSSED 1 * * * 2 (5) One member appointed by the St. Tammany Parish Police Jury Council, 3 who shall be a resident of the Ninth Ward of said parish. 4 (6) One member appointed by the Greater Slidell Area St. Tammany 5 Chamber of Commerce. 6 * * * 7 (10) One member appointed by the state senator for District 11 East St. 8 Tammany Business Alliance. 9 * * * 10 (12) One member appointed by the state senator for District 1, provided that 11 such senator's district comprises portions of Ward Eight or Ward Nine. 12 * * * 13 §4575.3. Powers and duties 14 The board shall have all powers necessary or convenient to effectuate the 15 purposes of the district, including but not limited to the following rights and powers: 16 * * * 17 (20)(a) To With the approval of the State Bond Commission, to levy a tax 18 based upon the occupancy of hotel rooms, motel rooms, and overnight camping 19 facilities within the district in order to provide funds for the operation of the district, 20 including the construction, acquisition, development, maintenance, repair, 21 reconstruction, refurbishment, renovation, operation of or administration of any 22 facility owned, or to be owned or operated by the district and the acquisition, 23 construction repair or replacement of machinery, equipment, and furnishings. The 24 tax shall not exceed two dollars per occupant day. 25 * * * 26 Section 2. This Act shall become effective upon signature by the governor or, if not 27 signed by the governor, upon expiration of the time for bills to become law without signature 28 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. DIGEST SB 27 Engrossed 2020 Regular Session Hewitt Present law, relative to the Harbor Center District, provides for the control and management of the district to be vested in a 14-member board of commissioners. Provides that the board shall be appointed as follows: (1)One member appointed by the mayor of the city of Slidell. (2)Three members appointed by the city council of the city of Slidell, one of which is recommended for appointment by the St. Tammany Hotel-Motel Association and is an owner or operator of a hotel, motel, or a campground located in Ward Eight or Ward Nine of St. Tammany Parish. (3)One member appointed by the board of aldermen of the town of Pearl River. (4)One member appointed by the St. Tammany Parish Council, who is a resident of the Eighth Ward of the parish. (5)One member appointed by the St. Tammany Parish Police Jury, who is a resident of the Ninth Ward of the parish. (6)One member appointed by the Greater Slidell Area Chamber of Commerce. (7)One member appointed by the state representative for District 90. (8)One member appointed by the state representative for District 76. (9)One member appointed by the state representative for District 74. (10)One member appointed by the state senator for District 11. (11)One member who is the executive director of the St. Tammany Parish Tourist and Convention Commission. (12)One member appointed by the state senator for District 1, provided that such senator's district comprises portions of Ward Eight or Ward Nine. Proposed law retains present law with the following exceptions: (1)Changes an appointment from the Greater Slidell Area Chamber of Commerce to the St. Tammany Chamber of Commerce. (2)Changes an appointment from the state senator for District 11 to the East St. Tammany Business Alliance. (3)Removes the qualification that the senator's district comprise portions of Ward Eight or Ward Nine for the state senator representing District 1 to be qualified to make an appointment. Present law provides for the board of the Harbor Center District to levy a tax based upon the occupancy of hotel rooms, motel rooms, and overnight camping facilities within the district, Page 3 of 4 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 27 SLS 20RS-3 ENGROSSED with the approval of the State Bond Commission, in order to provide funds for the operation of the district, including the construction, acquisition, development, maintenance, repair, reconstruction, refurbishment, renovation, operation of or administration of any facility owned, or to be owned or operated by the district and the acquisition, construction repair or replacement of machinery, equipment, and furnishings. The tax shall not exceed two dollars per occupant day. Proposed law retains present law but removes the requirement that the State Bond Commission must approve the levying of the tax. Effective upon signature of the governor or lapse of time for gubernatorial action.
