SENATE BILL NO. 282

CLERKS OF COURT.  Provides relative to group insurance expenses for certain clerks of
court. (8/1/20)
1	AN ACT
2 To amend and reenact R.S. 13:783(F)(7), relative to clerks of court; to provide for payment
3 of premium costs for retirees from certain clerk of court offices; to provide for
4 requirements; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 13:783(F)(7) is hereby amended and reenacted to read as follows:

11	(7) In the parishes of Avoyelles, Bossier, Caddo, Calcasieu, Caldwell,
12 Cameron, Franklin, Grant, Iberia, Lafayette, LaSalle, Orleans, Ouachita, Pointe
13 Coupee, St. Martin, Terrebonne, Webster, West Feliciana, and Winn, the clerk of
14 court shall pay, from the clerk's salary fund, one hundred percent of the premium
15 costs of the group life and accidental death and dismemberment, group health,
16 accident, dental, hospital, surgical, or other medical expense insurance for any
17 employee that retires and elects to continue such coverage upon retirement from

1 the Avoyelles Parish clerk of court's office, Bossier Parish clerk of court's office, the
2 Caddo Parish clerk of court's office, the Calcasieu Parish clerk of court's office, the
3 Caldwell Parish clerk of court's office, the Cameron Parish clerk of court's office, the
4 Franklin Parish clerk of court's office, the Grant Parish clerk of court's office, the
5 Iberia Parish clerk of court's office, the Lafayette Parish clerk of court's office, the
6 LaSalle Parish clerk of court's office, the Orleans Parish Civil District Court clerk
7 of court's office, the Orleans Parish Criminal District Court clerk of court's office,
8 the Ouachita Parish clerk of court's office, the Pointe Coupee Parish clerk of court's
9 office, the St. Martin Parish clerk of court's office, the Terrebonne Parish clerk of
10 court's office, the Webster Parish clerk of court's office, the West Feliciana Parish
11 clerk of court's office, or the Winn Parish clerk of court's office who is entitled to
12 receive monthly benefits from the Louisiana Clerks' of Court Retirement and Relief
13 Fund, who has at least twenty years of full-time service with the clerk of court's
14 office in Avoyelles Parish, Bossier Parish, Caddo Parish, Calcasieu Parish, Caldwell
15 Parish, Cameron Parish, Franklin Parish, Grant Parish, Iberia Parish, Lafayette
16 Parish, LaSalle Parish, Ouachita Parish, Pointe Coupee Parish, St. Martin Parish,
17 Terrebonne Parish, Webster Parish, West Feliciana Parish, or Winn Parish, Orleans
18 Parish Civil District Court, or Orleans Parish Criminal District Court, and who is at
19 least fifty-five years of age. The provisions of this Paragraph shall not apply to any
20 other insurance, such as supplemental insurance, that an employee may elect to
21 purchase.

Present law provides that each of the clerks of court of the district courts is authorized to
contract separately or through the insurance committee that administers the clerk's insurance
fund to obtain insurance from any insurance company authorized to do business in
Louisiana. Further provides that such insurance may cover the clerk of court, the clerk's
employees, dependents of the clerk, and dependents of the clerk's employees.
Proposed law retains present law.

Present law provides that the clerk of court shall pay from the clerk's salary fund, 100% of
the premium costs of the group life and accidental death and dismemberment, group health,
accident, dental, hospital, surgical, or other medical expense insurance for any employee that
retires with at least 20 years of full-time service, is at least 55 years of age, and is eligible
to receive monthly benefits from the La. Clerk's of Court Retirement and Relief Fund.
Proposed law retains present law and requires that retiree must elect to continue the coverage
upon retirement.
Effective August 1, 2020.
