2020 Regular Session ENROLLED SENATE BILL NO. 313 BY SENATOR PETERSON 1 AN ACT 2 To enact R.S. 33:4096(A)(1)(c)(iv), relative to the Sewerage and Water Board of New 3 Orleans; to provide relative to exemptions related to the Orleans Parish School 4 Board; and to provide for related matters. 5 Notice of intention to introduce this Act has been published. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 33:4096(A)(1)(c)(iv) is enacted to read as follows: 8 ยง4096. New Orleans sewerage and water board; water rates; water revenue bonds 9 A.(1) The Sewerage and Water Board of New Orleans shall fix the rates to 10 be charged consumers of water, including the power to exceed the total rates in force 11 on November 1, 1913, and shall collect the same from all persons who use water 12 from the public water supply except that: 13 * * * 14 (c) The Orleans Parish School Board shall be exempt as follows: 15 * * * 16 (iv) Notwithstanding any provisions of law to the contrary, the exemption 17 outlined in this Subsection may be superceded by a mutually agreed upon and 18 executed cooperative endeavor agreement between the Sewerage and Water 19 Board of New Orleans and the Orleans Parish School Board, wherein the terms 20 of the cooperative endeavor agreement shall govern the rate and means by 21 which public schools in Orleans Parish are charged for water and sewer 22 services. 23 * * * ACT No. 120 Page 1 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. This Act shall become effective upon signature by the governor or, if not 2 signed by the governor, upon expiration of the time for bills to become law without signature 3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 4 vetoed by the governor and subsequently approved by the legislature, this Act shall become 5 effective on the day following such approval.
