DIGEST SB 37 Original 2020 Regular Session Boudreaux Present law provides for permission of certain identified persons to give written consent to move the remains of a deceased person. Proposed law retains present law and adds authority for a Person Authorized to Direct Disposition, also referred to as the PADD, as indicated on the DD Form 93 or its successor form by a member of the United States Armed Forces, the United States Reserve Forces, or National Guard, pursuant to a United States Department of Defense Record of Emergency Data, known as DD Form 93, or its successor form, the right to control interment for the decedent, including permission to move the remains. Proposed law provides immunity from liability for a cemetery authority, funeral establishment, funeral director, crematory authority, or the employees or agents of any of them to whom a copy of a DD Form 93 has been presented for interment or other disposition of the decedent's remains, including moving the remains of the decedent pursuant to the form and relying on the representation of the manner of decedent's death. Proposed law shall be known and may be cited as "The United States Air Force Airman First Class Eugene Joseph Sonnier, III Act".
