SENATE BILL NO. 374
BY SENATOR CLOUD 
MOTOR VEHICLES.  Requires course material and testing on recognition, prevention, and
reporting of human trafficking as part of commercial motor vehicle written knowledge test.

1	AN ACT
2 To enact R.S. 32:402.2 and R.S. 40:1465, relative to a commercial driver license; to provide
3 for course materials and testing on the recognition, prevention, and reporting of
4 human trafficking; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 32:402.2 is hereby enacted to read as follows: 
7 §402.2. Driver education; commercial driver license; human trafficking
8	A. The Department of Public Safety and Corrections, public safety
9 services, shall include course materials in its "Commercial Driver License
10 Manual" on the recognition, prevention, and reporting of human trafficking.
11	B.  The written knowledge test administered to an applicant for a Class
12 "A", "B", or "C" commercial driver license shall include at least two questions
13 relative to the recognition, prevention, and reporting of human trafficking.
14 Section 2. R.S. 40:1465 is hereby enacted to read as follows:
15 §1465. Driver training; commercial driver license; human trafficking
16	A. Any trade school, community college, agency, public or private school,
17 or person offering instruction in the operation of commercial motor vehicles as

1 part of a commercial motor vehicle driving course curriculum shall include
2 industry specific training on the recognition, prevention, and reporting of
3 human trafficking.
4	B. (1) The Board of Regents shall identify and establish industry specific
5 training materials for use in instruction on the recognition, prevention, and
6 effective reporting of human trafficking by persons as a requirement to obtain
7 a Class "A", "B", or "C" commercial driver license. The board may collaborate
8 with organizations that specialize in and offer training materials on the
9 recognition, prevention, and reporting of human trafficking for commercial
10 truckers. The board shall review and update the training materials to take into
11 account changes and trends in human trafficking. The board shall provide the
12 training materials to the Department of Public Safety and Corrections for
13 inclusion in its "Commercial Driver License Manual".
14	(2) The Department of Public Safety and Corrections, public safety
15 services, shall include the training materials identified and established by the
16 Board of Regents in its "Commercial Driver License Manual".
17 Section 2. R.S. 40:1465(B)(1) as enacted by this Act shall become effective on
18 August 1, 2020. The remainder of this Act shall become effective on January 1, 2021.

of a commercial motor vehicle driving course curriculum to include industry specific
training on the recognition, prevention, and reporting of human trafficking.
Proposed law requires the Board of Regents to identify and establish industry specific

of human trafficking for commercial truckers; further, requires the board to review and
update the training materials to take into account changes and trends in human trafficking.
Proposed law requires the board to provide the training materials to the DPSC for inclusion
in its "Commercial Driver License Manual".
Proposed law provision requires the Board of Regents to identify and establish training
materials effective August 1, 2020. The remainder of the Act shall become effective
January 1, 2021.
