SENATE BILL NO. 386

MINERALS.  Establishes the Commission for Louisiana's Energy, Environment, and
Restoration.  (gov sig)
1	AN ACT
2 To enact Part I of Chapter 6 of Title 30 of the Louisiana Revised Statutes of 1950, to be
3 comprised of R.S. 30:401 through 403, relative to minerals, oil, and gas and
4 environmental quality; to establish the Commission for Louisiana's Energy,
5 Environment, and Restoration; to provide for a purpose; to provide for membership;
6 to provide for an operational plan and legislative recommendations; and to provide
7 for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1.  Part I of Chapter 6 of Title 30 of the Louisiana Revised Statutes of 1950,
10 to be comprised of R.S. 30:401 through 403 is hereby enacted to read as follows:

12	QUALITY CHAPTER 6. MISCELLANEOUS PROVISIONS
13	PART I. COMMISSION FOR LOUISIANA'S ENERG Y,
14	ENVIRONMENT, AND RESTORATION
15 §401.  Commission for Louisiana's Energy, Environment, and Restoration;
16	purpose
17	There is hereby created the Commission for Louisiana's Energy,

1 Environment, and Restoration within the Department of Natural Resources.
2 The commission shall support programs designed to demonstrate to the general
3 public the importance of the Louisiana oil and natural gas exploration,
4 production, and service industry; encourage the wise and efficient use of
5 energy; promote environmentally sound production methods and technologies;
6 develop existing supplies of Louisiana's oil and natural gas resources; support
7 research and educational activities concerning the oil and gas exploration and
8 production industry; cause remediation of historical oilfield environmental
9 problems; and to have such other authority as provided by law.
10 §402. Commission membership; domicile; chair; term; vacancies; quorum;
11	compensation
12	A. The commission shall be composed of the following members:
13	(1)(a) One member appointed by the governor chosen from a list of three
14 names submitted by the Louisiana Landowners Association board of directors.
15	(b) One member appointed by the governor chosen from a list of three
16 names submitted by the Louisiana Oil and Gas Association board of directors.
17	(c) One member appointed by the governor chosen from a list of three
18 names submitted by the Louisiana Mid-Continent Oil and Gas Association
19 board of directors.
20	(2) Two members appointed by the speaker of the House of
21 Representatives chosen from a list of six names submitted by the Louisiana Oil
22 and Gas Association board of directors.
23	(3) Two members appointed by the president of the Senate chosen from
24 a list of six names submitted by the Louisiana Mid-Continent Oil and Gas
25 Association board of directors.
26	B. The commission shall be domiciled in East Baton Rouge Parish.
27	C. At the first meeting, to be held no later than September 1, 2020, the
28 board shall elect a chair and any other officers it considers necessary for the
29 effective operation of the commission.

1	D. The terms of the members shall be concurrent with that of the
2 governor. Members may be re-appointed.
3	E. Vacancies shall be filled in the same manner as the original
4 appointment.
5	F. A majority of the members of the commission shall constitute a
6 quorum for the purpose of taking any action. Actions of the commission may be
7 taken by an affirmative vote of the members of the commission present.
8	G. Members of the commission shall serve without compensation.
9 §403. Operational plan; legislative recommendations
10	A. The commission shall develop an operational plan and legislative
11 recommendations for the 2021 Regular Session of the Legislature necessary to
12 implement the operational plan by July 1, 2021.
13	B. Department and legislative staff shall assist the commission in
14 developing the operational plan and legislative recommendations.
15	C. The operational plan of the commission and legislative
16 recommendations shall be presented to the Senate Committee on Natural
17 Resources and the House Committee on Natural Resources and Environment
18 no later than March 1, 2021.
19 Section 2.  This Act shall become effective upon signature by the governor or, if not
20 signed by the governor, upon expiration of the time for bills to become law without signature
21 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
22 vetoed by the governor and subsequently approved by the legislature, this Act shall become
23 effective on the day following such approval.

Proposed law creates the Commission for Louisiana's Energy, Environment, and Restoration
within the Department of Natural Resources (DNR) for the purpose of supporting programs
designed to demonstrate to the general public the importance of the Louisiana oil and natural
gas exploration, production, and service industry; encouraging the wise and efficient use of
energy; promoting environmentally sound production methods and technologies; developing

Proposed law requires the commission to develop an operational plan and legislative
recommendations for the 2021 Regular Session of the Legislature necessary to implement
the operational plan by July 1, 2021.
Proposed law requires that DNR and legislative staff to assist the commission in developing
the operational plan and legislative recommendations.
Proposed law requires the operational plan of the commission and legislative
recommendations to be presented to the Senate Committee on Natural Resources and the
House Committee on Natural Resources and Environment no later than March 1, 2021.
Effective upon signature of the governor or lapse of time for gubernatorial action.
