SENATE BILL NO. 386

1	AN ACT
2 To enact Part I of Chapter 6 of Title 30 of the Louisiana Revised Statutes of 1950, to be
3 comprised of R.S. 30:401 through 403, relative to minerals, oil, and gas and
4 environmental quality; to establish the Advisory Commission for Louisiana's Energy,
5 Environment, and Restoration; to provide for a purpose; to provide for membership;
6 to provide for an operational plan and legislative recommendations; and to provide
7 for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1.  Part I of Chapter 6 of Title 30 of the Louisiana Revised Statutes of 1950,
10 to be comprised of R.S. 30:401 through 403, is hereby enacted to read as follows:

13 PART I. ADVISORY COMMISSION F OR LOUISIANA'S ENERG Y,
14	ENVIRONMENT, AND RESTORATION
15 §401. Advisory Commission for Louisiana's Energy, Environment, and
16	Restoration; purpose
17	There is hereby created the Advisory Commission for Louisiana's
18 Energy, Environment, and Restoration within the Department of Natural
19 Resources. The commission shall support programs designed to demonstrate to
20 the general public the importance of the Louisiana oil and natural gas
21 exploration, production, and service industry; encourage the wise and efficient
22 use of energy; promote environmentally sound production methods and
23 technologies; develop existing supplies of Louisiana's oil and natural gas
24 resources; support research and educational activities concerning the oil and
25 gas exploration and production industry; cause remediation of historical oilfield

1 environmental problems; and to have such other authority as provided by law.
2 §402. Commission membership; domicile; chair; term; vacancies; quorum;
3	compensation
4	A. The commission shall be composed of the following members:
5	(1)(a) One member appointed by the governor chosen from a list of three
6 names submitted by the Louisiana Landowners Association board of directors.
7	(b) One member appointed by the governor chosen from a list of three
8 names submitted by the Louisiana Oil and Gas Association board of directors.
9	(c) One member appointed by the governor chosen from a list of three
10 names submitted by the Louisiana Mid-Continent Oil and Gas Association
11 board of directors.
12	(2) Two members appointed by the speaker of the House of
13 Representatives chosen from a list of six names submitted by the Louisiana Oil
14 and Gas Association board of directors.
15	(3) Two members appointed by the president of the Senate chosen from
16 a list of six names submitted by the Louisiana Mid-Continent Oil and Gas
17 Association board of directors.
18	B. The commission shall be domiciled in East Baton Rouge Parish.
19	C. At the first meeting, to be held no later than September 1, 2020, the
20 board shall elect a chair and any other officers it considers necessary for the
21 effective operation of the commission.
22	D. The terms of the members shall be concurrent with that of the
23 governor. Members may be re-appointed.
24	E. Vacancies shall be filled in the same manner as the original
25 appointment.
26	F. A majority of the members of the commission shall constitute a
27 quorum for the purpose of taking any action. Actions of the commission may be
28 taken by an affirmative vote of the members of the commission present.
29	G. Members of the commission shall serve without compensation.
30 §403. Operational plan; legislative recommendations

1	A. The commission shall develop an operational plan and legislative
2 recommendations for the 2021 Regular Session of the Legislature necessary to
3 implement the operational plan by July 1, 2021.
4	B. Department and legislative staff shall assist the commission in
5 developing the operational plan and legislative recommendations.
6	C. The operational plan of the commission and legislative
7 recommendations shall be presented to the Senate Committee on Natural
8 Resources and the House Committee on Natural Resources and Environment
9 no later than March 1, 2021.
10 Section 2.  This Act shall become effective upon signature by the governor or, if not
11 signed by the governor, upon expiration of the time for bills to become law without signature
12 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
13 vetoed by the governor and subsequently approved by the legislature, this Act shall become
14 effective on the day following such approval.
