SENATE BILL NO. 419
BY SENATOR ROBERT MILLS AND REPRESENTATIVE SEABAUGH 
LIABILITY.  Provides relative to $500,000 limitation on general damages. (8/1/20)
1	AN ACT
2 To enact Civil Code Article 2315(C), relative to damages; to provide for a limitation on
3 general damages; to define general damages; and to provide for related matters.
4 Be it enacted by the Legislature of Louisiana:
5 Section 1.  Civil Code Article 2315(C) is hereby enacted to read as follows:
6 Art. 2315.  Liability for acts causing damages
7	*          *          *
8	C.(1)  The total amount recoverable for general damages exclusive of
9 economic or special damages shall not exceed five hundred thousand dollars
10 plus interest and costs.
11	(2)  In this Paragraph, "general damages" are defined as damages that
12 may not be fixed with any degree of pecuniary exactitude or measured definitely
13 in terms of money and which include mental or physical pain or suffering,
14 inconvenience, the loss of gratification of intellectual or physical enjoyment, or
15 other losses of life or lifestyle.

Present law provides that every act of a person that causes damage to another obliges that
person who is at fault to repair it.
Present law provides that damages may include loss of consortium, service, and society, but
does not include such costs as future medical treatment.
Proposed law provides for a $500,000 limitation for general damages, excluding special or
economic damages, in civil suits.
Proposed law defines "general damages".
Effective August 1, 2020.
