SENATE BILL NO. 455

ALCOHOLIC BEVERAGES.  Provides relative to the limitation on size of containers of
beverages of high alcoholic content. (8/1/20)
1	AN ACT
2 To amend and reenact the introductory paragraph of R.S. 26:351, (1)(a), and (3)(a), and to
3 repeal R.S. 26:351(7), relative to the limitation on size of containers of beverages of
4 high alcohol content; to authorize wholesalers and manufacturers to possess and pack
5 distilled spirits in certain containers; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. The introductory paragraph of R.S. 26:351, (1)(a), and (3)(a) are hereby
8 amended and reenacted to read as follows:
9 ยง351. Limitation on size of containers of beverages of high alcoholic content;
10	standards of fill
11	Except for wines, no manufacturer or wholesaler in this state shall have in his
12 possession any beverages of high alcoholic content outside of his bonded stockroom
13 unless they are in containers of no greater capacity than 1.75 one and seventy-five
14 one hundredths liters. The standards of fill shall be the following:
15	(1)(a) All distilled spirits sold in or shipped into this state shall be in the
16 following containers: One and seventy-five hundredths liters, one liter, seven
17 hundred fifty milliliters, five hundred milliliters, three hundred seventy-five

1 milliliters, and two hundred milliliters, and fifty milliliters.

3	(3)(a) Distilled spirits, whether domestically bottled or imported, subject to
4 the metric standard of fill prescribed in Paragraph (1) above shall be packed with the
5 following number of containers per shipping case or container:

17 Section 2.  R.S. 26:351(7) is hereby repealed.

Present law prohibits any manufacturer or wholesaler in this state to have in his possession
any beverages of high alcoholic content outside of his bonded stockroom unless they are in
containers of no greater capacity than 1.75 liters. The standards of fill shall be the following:
(1)1.75 liters
(2)One liter
(3)750 milliliters
(4)500 milliliters
(5)375 milliliters
(6)200 milliliters
Proposed law retains present law and adds 50 milliliter containers to the list of legal

standards of fill.
Present law provides for an exemption to the current 50 milliliter prohibition in hotels or
motels located in Bossier, Caddo, Calcasieu, East Baton Rouge, Jefferson, Lafayette,
Orleans, Ouachita, and Rapides parishes.
Proposed law repeals present law.
Effective August 1, 2020.
