R.S. 11:710(A)(4)(c) is hereby enacted to read as follows: 8 §710. Employment of retirees 9 A. The cost of this Act, if any, shall be funded with additional employer 4 contributions in compliance with Article X, Section 29(F) of the Constitution of Louisiana. 5 Section 3. This Act shall become effective upon signature by the governor or, if not 6 signed by the governor, upon expiration of the time for bills to become law without signature 7 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 8 vetoed by the governor and subsequently approved by the legislature, this Act shall become 9 effective on the day following such approval. DIGEST SB 484 Original 2020 Regular Session Robert Mills Present law, relative to the Teachers' Retirement System of Louisiana (TRSL) provides for the employment of retired teachers. Provides that the benefit of a retiree who is re-employed in a "critical shortage position" as defined in present law will be suspended if the reemployment is within the 12-month period immediately following the person's retirement. Provides that after the lapse of 12 months, benefit payments resume. Proposed law retains present law and adds to the definition of "critical shortage position" a position for a full-time or part-time classroom teacher who teaches any student in a school identified pursuant to the Every Student Succeeds Act (ESSA) for comprehensive intervention or as having 75% or more economically disadvantage students where a critical shortage exists. Present law provides for the determination and certification that a critical shortage exists, including advertising the position sought to be filled and certifying to the Board of Elementary and Secondary Education that the shortage exists. Proposed law retains present law. Proposed law provides that the actuarial cost of proposed law shall be funded with additional employer contributions, in compliance with present constitution.
