SENATE BILL NO. 493

AGRICULTURAL COMMODITIES.  Provides relative to industrial hemp-derived
cannabidiol products.  (CA7s2.1(A)) (8/1/20)
1	AN ACT
2 To amend and reenact R.S. 3:1482(A)(1) and to enact R.S. 3:1485, relative to industrial
3 hemp-derived cannabidiol products; to clarify process or selling prohibitions; to
4 enact civil penalties; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 3:1482(A)(1) is hereby amended and reenacted and R.S. 3:1485 is
7 hereby enacted to read as follows: 
8 §1482. CBD products; prohibitions; Louisiana Department of Health
9	A. No person shall process or sell:
10	(1) Any part of hemp for inhalation, except for hemp rolling papers.

12 §1485. Civil penalties
13	At the discretion of the commissioner and in lieu of the criminal penalties
14 provided for by R.S. 3:1484, any licensee who violates any of the provisions of
15 this Part may be subject to having his permit suspended or revoked, in addition
16 to any other penalties authorized by law.

Present law provides for regulation of industrial hemp-derived cannabidiol products defined
as any industrial hemp-derived product or hemp-derived product that contains cannabidiol
(CBD) intended for consumption or topical use.
Present law provides that no person shall process or sell:
(1)Any part of hemp for inhalation.
(2)Any alcoholic beverage containing CBD.
(3)Any food product or beverage containing CBD unless the United States Food and
Drug Administration approves CBD as a food additive.
Proposed law retains present law, but clarifies that hemp rolling papers are not included in
the prohibition.
Present law requires each person who sells or is about to engage in the business of selling
at retail, any industrial hemp-derived CBD product to first apply for and obtain a permit for
each place of business from the office of alcohol and tobacco control.
Proposed law authorizes the commissioner of the office of alcohol and tobacco control, in
her discretion, to suspend or revoke a permit for a violation of present law, in addition to any
other penalties authorized by present law.
Effective August 1, 2020.
