SENATE BILL NO. 509

SCHOOLS.  Provides relative to performance audits of charter schools in certain school
systems. (gov sig)
1	AN ACT
2 To enact R.S. 17:10.7.2, relative to charter schools in certain school systems that have
3 transferred schools to the Recovery School District; to provide for a performance
4 audit of certain charter schools in such systems; to provide for a moratorium on the
5 issuance of new charters in such systems; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 17:10.7.2 is hereby enacted to read as follows:
8 ยง10.7.2. School systems that have transferred schools to the Recovery School
9	district; charter school performance audit; moratorium on new
10	charters
11	A. The provisions of this Section shall be applicable only to a school
12 system from which one or more schools have been transferred to the Recovery
13 School District pursuant to R.S. 17:10.7.
14	B. To the extent that the provisions of this Section conflict with the
15 provisions of Chapter 42 of this Title, the provisions of this Section shall prevail.
16	C.(1) The legislative auditor shall conduct a performance audit on every
17 charter school in a school system that has had one or more schools transferred

1 to the Recovery School District pursuant to R.S. 17:10.7, that was granted a
2 charter between January 1, 2005, and January 1, 2020. The audit, at a
3 minimum, shall identify and analyze the different and innovative teaching
4 methods utilized in each school in the school system, the extent to which
5 identified successful methods have been replicated in other schools, and the
6 names of the schools which implemented such methods.
7	(2) The audit shall be conducted, and the requested information
8 provided, by school by year.
9	(3) The legislative auditor shall submit a report of the audit findings to
10 the Senate Committee on Education and the House Committee on Education not
11 later than September 30, 2021.
12	D. No new charters shall be issued in the school system until the analysis
13 and school performance audits have been completed and the required report
14 submitted to the specified legislative committees. However, nothing in this
15 Section shall be construed as prohibiting the renewal of an existing charter,
16 provided the charter school has a school performance letter grade of "D" of
17 higher.
18 Section 2.  This Act shall become effective upon signature by the governor or, if not
19 signed by the governor, upon expiration of the time for bills to become law without signature
20 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
21 vetoed by the governor and subsequently approved by the legislature, this Act shall become
22 effective on the day following such approval.

Present law provides for the transfer of certain schools in a district in academic crisis to the
Recovery School District.
Proposed law requires the legislative auditor to conduct a performance audit on every charter
school in a school system that has had one or more schools transferred to the Recovery
School District pursuant to R.S. 17:10.7, that was granted a charter between January 1, 2005,
and January 1, 2020. The audit, at a minimum, shall identify and analyze the different and

innovative teaching methods utilized in each school in the school system, the extent to which

schools which implemented such methods. Further requires the legislative auditor to submit
a report of audit findings to the Senate and House committees on education by 9/30/2021.
Proposed law prohibits the issuance of new charters in such a school system until the audits
are performed and the required report submitted.
Proposed law does not apply to the renewal of an existing charter that has a school
performance letter grade of "D" or higher.
Effective upon signature of the governor or lapse of time for gubernatorial action.
