(gov sig) 1 AN ACT 2 To amend and reenact R.S. 51:3143(B) and 3163(B), relative to certain contract providers; 3 to provide for registration with the secretary of state; to provide relative to the 4 application form and required information; to provide for procedures; and to provide 5 for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 51:3143(B) and 3163(B) are hereby amended and reenacted to read 8 as follows: 9 §3143. Requirements for doing business 10 * * * 11 B. Each provider of a home service contract sold in this state shall file an 12 application for an initial registration with the secretary of state consisting of his 13 name, address, telephone number, and contact person, designating a person in this 14 state for service of process, and providing a listing of all officers, all directors, and 15 all owners of ten percent or more of the business. Additionally, the provider shall file 16 a copy of its basic organizational documents, including articles of incorporation, 17 articles of organization, articles of association, or a partnership agreement. Beginning February 1, 2019, each Each provider of a motor vehicle 7 service contract sold in this state shall file an application for an initial registration 8 with the secretary of state consisting of the provider's name, address, telephone 9 number, and contact person, designating a person in this state for service of process, 10 and providing a listing of all officers, all directors, and all owners of ten percent or 11 more of the business. Additionally, the provider shall file a copy of its basic 12 organizational documents, including articles of incorporation, articles of 13 organization, articles of association, or a partnership agreement. Each application for 14 registration shall be accompanied by a fee of six hundred dollars. All fees shall be 15 paid to the secretary of state. 16 * * * 17 Section 2. This Act shall become effective upon signature by the governor or, if not 18 signed by the governor, upon expiration of the time for bills to become law without signature 19 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 20 vetoed by the governor and subsequently approved by the legislature, this Act shall become 21 effective on the day following such approval. DIGEST SB 55 Engrossed 2020 Regular Session Foil Present law provides relative to home service contract providers and motor vehicle contractor providers. Present law provides for application for initial registration and requires certain information be included in the application, including the telephone number of the provider. Proposed law removes the requirement that the provider include in the application his telephone number.
