Cost Summary: 
 
The estimated net actuarial and fiscal impact of this proposed legislation on the retirement systems and their plan sponsors is 
summarized below.  Net actuarial costs pertain to estimated changes in the net actuarial present value of future benefit payments and 
administrative expenses incurred by the retirement system.  Net fiscal costs or savings pertain to changes to all cash flows over the 
next five year period including retirement system cash flows, OPEB cash flows, or cash flows related to local and state government 
entities.  
 
An increase in actuarial costs is denoted throughout the actuarial note by “Increase” or a positive number.  Actuarial savings are 
denoted by “Decrease” or a negative number.  An increase in expenditures or revenues (fiscal impact) is denoted by “Increase” or a 
positive number.  A decrease in expenditures or revenues is denoted by “Decrease” or a negative number.

Bill Information 
 
Current Law 
 
Current law provides that benefits commence for retirees on the first day of the month following withdrawal from employment, 
provided such retirement receives board approval. 
 
On the other hand, current law provides that benefits for vested terminated members commence on the first day of the month 
following application for benefits and subsequent board approval. 
 
Proposed Law 
 
SB 7 provides that if a written application for any benefit is received by the board sixty or fewer days after the date the applicant 
became eligible for the benefit, the benefit will be paid retroactive to the date of eligibility. 
 
SB 7 further provides that if an application for any benefit is received by the board more than sixty days after the date the 
applicant attained eligibility, the retroactive benefits will be paid only for the sixty days prior to the date the application is 
received by the board. 
 
Implications of the Proposed Changes 
 
SB 7 applies new retroactivity rules to any benefit, presumably to include service retirements, disability, death and vested 
terminations.  SB 7 provides that the retroactive benefits will be paid, but for no more than the sixty days prior to the date the 
application is received by the board.

There will be no change in benefits for members who retire from the system and apply for benefits within 60 days.  For members 
who retire from the system but do not apply for benefits until after the 60-day period, retroactive benefits will only go back 60 
days.  So, retirees who apply for benefits more than 60 days following eligibility will receive fewer benefits than under present 
law. 
 
For members who leave with vested benefits but prior to actual retirement, and who apply after they become eligible for benefits, 
retroactive benefits will go back 60 days but not before the eligibility to receive such benefits.  So, vested terminated members 
who apply for benefits after their dates of eligibility will receive more benefits than under present law. 
 
 
I. ACTUARIAL IMPACT ON RETIREMENT SYSTEMS AND OPEB [Completed by LLA] 
 
A. Analysis of Net Actuarial Costs  
(Prepared by LLA) 
 
This section of the actuarial note pertains to net actuarial costs or savings associated with the retirement systems and with OPEB. 
 
1. Retirement Systems 
 
The net actuarial cost or savings of the proposed legislation associated with the retirement systems is estimated to be a slight 
increase in cost.  The actuary’s analysis is summarized below. 
 
Some retirees will have retroactive benefits reduced by SB 7, while some vested terminated members will become eligible 
for more retroactive benefits.  The former would cause a decrease in cost, while the latter would cause an increase in cost.  
So, the question is whether there would be a decrease or an increase in cost overall. 
 
It seems likely that a member who is retiring directly from service will need to have retirement benefits begin at eligibility to 
continue an income to replace earnings.  On the other hand, a vested terminated member may not have the same urgency 
about applying for benefits and may be more likely to apply after the date benefits were to begin.  Based on this analysis, we 
would expect the increase attributable to the change for vested terminated members to outweigh the decrease attributable to 
retirees. 
 
2. Other Post-employment Benefits (OPEB) 
 
The net actuarial cost or savings of the proposed legislation associated with OPEB, including retiree health insurance 
premiums, is estimated to be $0.  The actuary’s analysis is summarized below. 
 
The liability for post-retirement medical insurance subsidies provided to retirees is not affected by a change in the payments 
of retroactive benefits. 
 
B. Actuarial Data, Methods and Assumptions

Unless indicated otherwise, the actuarial note for the proposed legislation was prepared using actuarial data, methods, and 
assumptions as disclosed in the most recent actuarial valuation report adopted by the Public Retirement Systems’ Actuarial 
Committee (PRSAC). The data, methods and assumptions are being used to provide consistency with the actuary for the 
retirement system who may also be providing testimony to the Senate and House retirement committees. With certain exceptions, 
the actuary for the LLA finds the assumptions used by the retirement systems and PRSAC to be reasonable. 
 
C. Actuarial Caveat

There is nothing in the proposed legislation that will compromise the signing actuary’s ability to present an unbiased statement of 
actuarial opinion.

The proposed legislation will have the following effects on retirement related fiscal costs and revenues during the five year

2. Expenditures: 
 
a. MERS expenditures (Agy Self-Generated) will likely experience a net increase since more benefits are expected to be 
paid under SB 7 than under the current law. 
 
b. Expenditures from Local Funds will likely increase under SB 7 since more benefits will be paid and employer 
contribution requirements will therefore increase. 
 
3. Revenues: 
 
MERS revenues are expected to increase since the employer contribution requirement will increase.
