(gov sig) 1 AN ACT 2 To amend and reenact R.S. 17:3805(B), relative to the Education Excellence Fund; to 3 specify a date for the state Department of Education to submit school and school 4 system fund expenditure plans for legislative approval; and to provide for related 5 matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 17:3805(B) is hereby amended and reacted to read as follows: 8 ยง3805. SB NO. 84 SLS 20RS-299 ENGROSSED 1 Department of Education, the standing committees shall meet, either separately or 2 jointly, to consider and act on the plans. 3 (3) Approval shall be by motion which may be offered for all plans 4 considered at any meeting in globo or may, at the discretion of the chairperson 5 conducting the meeting, be acted on separately. Approval by either committee, 6 meeting separately, shall require a favorable vote on the motion by a majority of the 7 members present and voting, a quorum of the committee being present. Approval by 8 the two committees, meeting jointly, shall require a favorable vote on the motion by 9 a majority of the members thereof from each house present and voting, each house 10 voting separately, a quorum of the joint committee being present. 11 * * * 12 Section 2. This Act shall become effective upon signature by the governor or, if not 13 signed by the governor, upon expiration of the time for bills to become law without signature 14 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 15 vetoed by the governor and subsequently approved by the legislature, this Act shall become 16 effective on the day following such approval. DIGEST SB 84 Engrossed 2020 Regular Session Fields Present constitution provides for the Education Excellence Fund (EEF), which is part of the constitutionally established Millennium Trust Fund, to receive a specified share of the state's proceeds from the "Tobacco Settlement". Present constitution provides that monies available to be appropriated annually shall be allocated to each city, parish, or other local school board on a pro rata basis based on the ratio of the student population of the school or school system to that of the total state student population. Further provides that a portion of the funds shall be appropriated to BESE-approved private elementary and secondary schools, and other schools. Present law provides that before the monies can be disbursed to any school or school system, the state Department of Education (DOE) must review and approve the expenditure plans and submit and present the plans to the Senate and House education committees for approval. Proposed law requires DOE to submit the plans to the education committees for approval by November 15th of each year.
