Request the governor to issue an executive order requiring certain persons to wear a face covering in public under certain conditions and authorizing businesses to deny admittance to persons without face coverings. 1 A RESOLUTION 2 To urge and request the governor to issue an executive order requiring persons medically 3 able to tolerate a face covering when in a public place or if unable to maintain or not 4 maintaining social distance when in public and authorizing business operators, 5 building owners, and those authorized on their behalf to have the discretion to 6 require any individual over the age of two and able to medically tolerate a face 7 covering, to cover their nose and mouth with a mask or cloth face covering when 8 entering such business, including the discretion to deny admittance to individuals 9 who fail to comply with such directive which shall be applied in a manner consistent 10 with the American with Disabilities Act. 11 WHEREAS, pursuant to the Louisiana Homeland Security and Emergency 12 Assistance and Disaster Act, R.S. 29:721, et seq., the governor declared a public health 13 emergency in Proclamation Number 25 JBE 2020; and 14 WHEREAS, the worldwide outbreak of COVID-19 and the effects of its extreme risk 15 of person-to-person transmission throughout the United States and Louisiana significantly 16 threatens the safety, health, and security of the citizens of the state, along with public 17 facilities; and 18 WHEREAS, COVID-19 spreads mainly from person to person through respiratory Page 1 of 2 SR NO. 70 SLS 20RS-2367 ORIGINAL 1 droplets produced when an infected person coughs, sneezes, or talks; and 2 WHEREAS, these droplets can land in the mouths or noses of people who are nearby 3 or possibly be inhaled into the lungs; and 4 WHEREAS, studies and evidence on infection control report that these droplets 5 usually travel approximately six feet; and 6 WHEREAS, both the Louisiana Department of Health and the Centers for Disease 7 Control and Prevention recommends wearing cloth face coverings in public settings where 8 other social distancing measures are difficult to maintain. 9 THEREFORE, BE IT RESOLVED that the Senate of Legislature of Louisiana does 10 hereby request that the governor issue an executive order requiring persons medically able 11 to tolerate a face covering when in a public place or if unable to maintain or not maintaining 12 social distance when in public and authorizing business operators, building owners, and 13 those authorized on their behalf to have the discretion to require any individual over the age 14 of two and able to medically tolerate a face covering, to cover their nose and mouth with a 15 mask or cloth face covering when entering such business, including the discretion to deny 16 admittance to individuals who fail to comply with such directive which shall be applied in 17 a manner consistent with the American with Disabilities Act. 18 BE IT FURTHER RESOLVED that a copy of this Resolution be sent to 19 Governor John Bel Edwards.
