SENATE RESOLUTION NO. 70

A RESOLUTION
To urge and request the governor to issue an executive order requiring persons medically
able to tolerate a face covering who is in a place open to the public, whether indoor
or outdoor, and is unable or does not maintain a distance of approximately six feet
from every other person not in their household, shall cover their mouth and nose with
a cloth face covering, and authorizing business operators, building owners, and those
authorized on their behalf to have the discretion to require any individual over the
age of two and able to medically tolerate a face covering, to cover their nose and
mouth with a mask or cloth face covering when entering such business, including the
discretion to deny admittance to individuals who fail to comply with such directive
which shall be applied in a manner consistent with the American with Disabilities
Act.
WHEREAS, pursuant to the Louisiana Homeland Security and Emergency
Assistance and Disaster Act, R.S. 29:721, et seq., the governor declared a public health
emergency in Proclamation Number 25 JBE 2020; and
WHEREAS, the worldwide outbreak of COVID-19 and the effects of its extreme risk
of person-to-person transmission throughout the United States and Louisiana significantly
threatens the safety, health, and security of the citizens of the state, along with public
facilities; and
WHEREAS, COVID-19 spreads mainly from person-to-person through respiratory
droplets produced when an infected person coughs, sneezes, or talks; and
WHEREAS, these droplets can land in the mouths or noses of people who are nearby
or possibly be inhaled into the lungs; and
WHEREAS, studies and evidence on infection control report that these droplets
usually travel approximately six feet; and

WHEREAS, both the Louisiana Department of Health and the Centers for Disease
Control and Prevention recommends wearing cloth face coverings in public settings where
other social distancing measures are difficult to maintain.
THEREFORE, BE IT RESOLVED that the Senate of Legislature of Louisiana does
hereby request that the governor issue an executive order requiring persons medically able
to tolerate a face covering who are in a place open to the public whether indoor or outdoor
and are unable or do not maintain a distance of approximately six feet from every other
person not in their household shall cover their mouth and nose with a cloth face covering,
and authorizing business operators, building owners, and those authorized on their behalf to
have the discretion to require any individual over the age of two and able to medically
tolerate a face covering, to cover their nose and mouth with a mask or cloth face covering
when entering such business, including the discretion to deny admittance to individuals who
fail to comply with such directive which shall be applied in a manner consistent with the
American with Disabilities Act.
BE IT FURTHER RESOLVED that a copy of this Resolution be sent to
Governor John Bel Edwards.
