LIABILITY/CIVIL:  Provides for liability relative to the administration of COVID-19
vaccinations
1	AN ACT
2To enact R.S. 9:2800.28, relative to civil liability; to provide for civil liability when
3 requiring certain vaccinations under certain circumstances; to provide relative to
4 public and private entities; to provide for damages; and to provide for related
5 matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 9:2800.28 is hereby enacted to read as follows:
8 ยง2800.28.  Civil liability for requirement of COVID-19 vaccination
9	A.  Any public or private entity that requires a COVID-19 vaccination for
10 entry into a building owned or operated by the public or private entity, services
11 rendered by a public or private entity, employment, school admissions, or any other
12 reason shall be liable for all civil damages for injury or death resulting from or
13 related to the required COVID-19 vaccination.
14	B.  Notwithstanding the provisions of Subsection A of this Section, an
15 employee shall retain the rights and remedies granted under the Louisiana Workers'
16 Compensation Law.

rendered.
Proposed law retains the rights and remedies afforded to employees under the Louisiana
Workers' Compensation Law.
