AGRICULTURE:  Provides relative to the composition of the Louisiana Board of Animal
Health and its regulatory authority over the disposal of livestock animal carcasses
1	AN ACT
2To amend and reenact R.S. 3:2091(B)(12) and 2131, relative to the composition and
3 regulatory authority of the Louisiana Board of Animal Health; to provide for
4 composition of the board; to provide for disposal of livestock animal carcasses; to
5 provide relative to a definition; to provide for an effective date; and to provide for
6 related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 3:2091(B)(12) and 2131 are hereby amended and reenacted to read
9as follows:
10 §2091.  Louisiana Board of Animal Health

12	B.  The board shall consist of the following eighteen members appointed by
13 the commissioner of agriculture and forestry in accordance with the following
14 provisions:

16	(12)  One dairy farmer to be selected from persons nominated by organized
17 dairy cooperatives domiciled in Louisiana, each of which cooperatives may nominate
18 one dairy farmer.

1 §2131.  Cremation or burial Disposal of animal carcasses
2	A.(1)  In order to prevent, control, and eradicate anthrax or charbon, glanders,
3 blackleg, hemorrhagic septicemia, hog cholera, and all other contagious or
4 communicable diseases of mules, horses, cattle, sheep, goats, swine, and poultry
5 throughout the state, the carcasses of all animals shall be disposed of in a sanitary
6 manner by cremation or deep burial. cremation, deep burial, or other sanitary method
7 as approved by the United States Department of Agriculture.
8	(2)  Burial in this sense For purposes of Paragraph (1) of this Subsection,
9 "deep burial" means that the animal carcass shall be placed in a hole or pit not less
10 than six feet deep in the disposition of carcasses of cows, mules, poultry, and horses,
11 and not less than four feet as applying to carcasses of sheep, goats, and swine.
12	B.  The owners, agents, firms, or corporations, or persons in charge of any
13 or all livestock on ranges, pastures, or other premises shall be responsible for
14 disposition of all carcasses in those herds over which they have jurisdiction, with
15 reference to complying to the provisions of this Part.
16	C.  The provisions of this Part shall not apply to animal carcasses within the
17 limits of a city or town which is provided with an incinerator or in which a rendering
18 plant is operated, provided such incinerator or rendering plant is equipped with
19 facilities to properly transport or handle carcasses in a manner to prevent
20 dissemination of infection.
21 Section 2.  This Act shall become effective upon signature by the governor or, if not
22signed by the governor, upon expiration of the time for bills to become law without signature
23by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
24vetoed by the governor and subsequently approved by the legislature, this Act shall become
25effective on the day following such approval.

Abstract:  Removes the qualification that a dairy farmer appointed to the La. Bd. of Animal
Health must be selected from nominations made by dairy cooperatives, adds a
method of disposal of animals, and clarifies the term burial.
Present law requires the La. Bd. of Animal Health to consist of the appointment of one dairy
farmer selected from a list of persons nominated by organized dairy cooperatives domiciled
in La.
Proposed law removes the qualification that the dairy farmer must be selected from a list of
persons nominated by organized dairy cooperatives.
Present law provides for the disposal methods of cremation or deep burial of livestock
animal carcasses in order to prevent, control, and eradicate certain diseases of these animals. 
Proposed law adds any other sanitary method approved by the U.S. Dept. of Agriculture to
the list of accepted disposal methods.
Present law defines the term "burial".
Proposed law changes the term to "deep burial" but maintains the current definition.
Effective upon signature of governor or lapse of time for gubernatorial action.
