ENROLLED 2021 Regular Session HOUSE BILL NO. 104 BY REPRESENTATIVE WHEAT AND SENATORS MCMATH, POPE, AND W HITE 1 AN ACT 2 To amend and reenact R.S. 3:2091(B)(12) and 2131, relative to the composition and 3 regulatory authority of the Louisiana Board of Animal Health; to provide for 4 composition of the board; to provide for disposal of livestock animal carcasses; to 5 provide relative to a definition; to provide for an effective date; and to provide for 6 related matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 3:2091(B)(12) and 2131 are hereby amended and reenacted to read 9 as follows: 10 §2091. Louisiana Board of Animal Health 11 * * * 12 B. The board shall consist of the following eighteen members appointed by 13 the commissioner of agriculture and forestry in accordance with the following 14 provisions: 15 * * * 16 (12) One dairy farmer to be selected from persons nominated by organized 17 dairy cooperatives domiciled in Louisiana, each of which cooperatives may nominate 18 one dairy farmer. 19 * * * 20 §2131. Cremation or burial Disposal of animal carcasses 21 A.(1) In order to prevent, control, and eradicate anthrax or charbon, glanders, 22 blackleg, hemorrhagic septicemia, hog cholera, and all other contagious or 23 communicable diseases of mules, horses, cattle, sheep, goats, swine, and poultry 24 throughout the state, the carcasses of all animals shall be disposed of in a sanitary Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 104 ENROLLED 1 manner by cremation or deep burial. cremation, deep burial, or other sanitary method 2 as approved by the United States Department of Agriculture. 3 (2) Burial in this sense For purposes of Paragraph (1) of this Subsection, 4 "deep burial" means that the animal carcass shall be placed in a hole or pit not less 5 than six feet deep in the disposition of carcasses of cows, mules, poultry, and horses, 6 and not less than four feet as applying to carcasses of sheep, goats, and swine. 7 B. The owners, agents, firms, or corporations, or persons in charge of any 8 or all livestock on ranges, pastures, or other premises shall be responsible for 9 disposition of all carcasses in those herds over which they have jurisdiction, with 10 reference to complying to the provisions of this Part. 11 C. The provisions of this Part shall not apply to animal carcasses within the 12 limits of a city or town which is provided with an incinerator or in which a rendering 13 plant is operated, provided such incinerator or rendering plant is equipped with 14 facilities to properly transport or handle carcasses in a manner to prevent 15 dissemination of infection. 16 Section 2. This Act shall become effective upon signature by the governor or, if not 17 signed by the governor, upon expiration of the time for bills to become law without signature 18 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 19 vetoed by the governor and subsequently approved by the legislature, this Act shall become 20 effective on the day following such approval.
