SHERIFFS: Allows a sheriff or deputy sheriff to purchase a duty weapon upon retirement for fair market value 1 AN ACT 2To amend and reenact R.S. 11:2185, relative to sheriffs and deputy sheriffs; to provide 3 relative to the criteria for a sheriff or a deputy sheriff to purchase his firearm upon 4 retirement; and to provide for related matters. 5Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 11:2185 is hereby amended and reenacted to read as follows: 7 ยง2185. Retirement; purchase of firearm 8 A. Any sheriff or deputy sheriff who retires with at least sixteen years of 9 active service and who is in good standing with the Louisiana Sheriffs' Pension and 10 Relief Fund shall be entitled to purchase his firearm at fair market value upon 11 retirement, subject to approval by the sheriff. If the qualifying sheriff or deputy 12 sheriff was unable to purchase his firearm prior to his death, an immediate family 13 member listed in Subsection B of this Section has the right of first refusal to 14 purchase the firearm unless the immediate family member is prohibited from 15 possessing a firearm under the provisions of R.S. 14:95.1 or any other state or federal 16 law. 17 * * * Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Present law provides that a sheriff or deputy sheriff who retires with at least 16 years of active service and who is in good standing with the La. Sheriffs' Pension and Relief Fund is entitled to purchase his firearm at fair market value upon retirement, subject to approval by the sheriff. Proposed law removes the years of active service requirement and otherwise retains present law.
