AGRICULTURE:  Provides relative to aquaculture development and the Louisiana Aquatic
Chelonian Research and Promotion Board
1	AN ACT
2To repeal Part XVII of Chapter 5 of Title 3 of the Louisiana Revised Statutes of 1950,
3 comprised of R.S. 3:559.21 through 559.29, and R.S. 36:629(Q), relative to the
4 Louisiana Aquatic Chelonian Research and Promotion Board; to provide for
5 abolishment of the board; to provide for transfer of unclassified service positions; to
6 provide for transfer and disposition of monies; to provide for an effective date; and
7 to provide for related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  Part XVII of Chapter 5 of Title 3 of the Louisiana Revised Statutes of
101950, comprised of R.S. 3:559.21 through 559.29, and R.S. 36:629(Q) are hereby repealed
11in their entirety.
12 Section 2.  The positions authorized pursuant to R.S. 3:559.24(B) shall be transferred
13to the aquacultural development program established under the provisions of R.S. 3:559.1
14et seq.
15 Section 3.  Upon the effective date of this Act, the Department of Agriculture and
16Forestry shall transfer any remaining monies received by the Louisiana Aquatic Chelonian
17Research and Promotion Board to the Louisiana Agricultural Finance Authority to fund all
18costs related to a campaign for expanding research related to aquatic chelonians, improving
19the quality and variety of Louisiana aquatic chelonians through research, and increasing
20sales of Louisiana aquatic chelonians through advertising and marketing.

1 Section 4.  This Act shall become effective upon signature by the governor or, if not
2signed by the governor, upon expiration of the time for bills to become law without signature
3by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
4vetoed by the governor and subsequently approved by the legislature, this Act shall become
5effective on the day following such approval.

Abstract:  Abolishes the La. Aquatic Chelonian Research and Promotion Bd. and provides
for the transfer of positions and monies associated with the board.
Present law creates the La. Aquatic Chelonian Research and Promotion Bd. (board), 
provides for its purpose and powers, as well as the composition of the board and its officers,
authorizes the board to assess a fee on all aquatic chelonians produced in La., creates a
process for refunds, establishes a fund within the La. Dept. of Agriculture and Forestry
(LDAF) for the deposit and disbursement of fees and other monies received under this Part
to use for paying the costs related to the promoting of research, advertising, and marketing
of aquatic chelonians, and provides for offenses and penalties.
Proposed law repeals present law.
Present law places the board within the LDAF.

Proposed law transfers any monies received by the board to the La. Agriculture Finance
Authority to fund all costs related to a campaign for expanding research related to aquatic
chelonians, improving the quality and variety of La. aquatic chelonians through research,

Present law requires the board to employ a director and assistant director in unclassified
service positions under the supervision of the commissioner of agriculture and forestry.
Proposed law transfers the present law positions to the aquaculture development program
established by law under the LDAF.
Effective upon signature of the governor or lapse of time for gubernatorial action.
