Existing law provides relative to employment for persons with disabilities. 
New law changes prior law by updating terminology referring to persons with disabilities.
Prior law provided that for the purpose of existing law, the term "employment" did not apply
to service performed in a facility conducted for the purpose of carrying out a program of
rehabilitation for individuals whose earning capacity was impaired by age or physical or
mental deficiency or injury or providing remunerative work for individuals who because of
their impairment could not readily compete in the labor market.
New law provides that for the purposes of existing law, the term "employment" does not
apply to service performed in a facility conducted for the purpose of carrying out a program
of rehabilitation for an individual whose earning capacity is affected by an injury or a
developmental, intellectual, physical, or age-related disability or providing remunerative
work for an individual who because of his physical or intellectual capacity cannot readily
compete in the labor market.
New law provides for an exception that states that an individual's employment shall be
considered employment under existing law if the individual's employment is defined as
employment under existing law and the individual is performing work under the AbilityOne
Program or a successor program under federal law.
Effective upon signature of governor (June 11, 2021).
