MTR VEHICLE/DRIVER LIC:  Prohibits requiring vaccination verification or immunity
status for certain transactions or for inclusion on a driver's license or special
identification card
1	AN ACT
2To enact R.S. 32:411.2 and R.S. 40:1321(N)(3) and (4), relative to the issuance, renewal, or
3 revocation of a driver's license or special identification card; to prohibit the use of
4 vaccination verification or immunity status for the issuance, renewal, or revocation
5 of a state issued driver's license or special identification card; to prohibit the
6 inclusion of vaccination verification or immunity status on a state issued driver's
7 license or special identification card; and to provide for related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 32:411.2 is hereby enacted to read as follows:
10 §411.2.  Prohibition against the inclusion of vaccination verification or immunity
11	status on driver's licenses
12	A.  The Department of Public Safety and Corrections, office of motor
13 vehicles, is prohibited from making the issuance, renewal, or revocation of a state
14 issued driver's license contingent on vaccination verification or immunity status.
15	B.  The Department of Public Safety and Corrections, office of motor
16 vehicles, shall not include any vaccination verification or immunity status on a state
17 issued driver's license.

1 Section 2.  R.S. 40:1321(N)(3) and (4) are hereby amended and reenacted to read as
2follows:
3 §1321.  Special identification cards; issuance; veteran designation; disabled veteran
4	designation; university logo; "I'm a Cajun" designation; needs
5	accommodation designation; fees; expiration and renewal; exceptions;
6	prohibitions; promulgation of rules; promotion of use; persons less than
7	twenty-one years of age; the Protect and Save our Children Program;

12	(3)  The  Department of Public Safety and Corrections, office of motor
13 vehicles, is prohibited from making the issuance, renewal, or revocation of a state
14 issued special identification card contingent on vaccination verification or immunity
15 status.
16	(4)  The Department of Public Safety and Corrections shall not include any
17 vaccination verification or immunity status on a state issued special identification
18 card.

Abstract:  Prohibits the office of motor vehicles from including vaccination verification or
immunity status on a driver's license or state identification card and from using such
records for the issuance, renewal, or revocation of a driver's license or state
identification card.
Present law requires that a state identification card include, upon request, the card holder's
blood type on the back of the special identification card.  Present law prohibits action by any
private citizen, public officer, or employee to create a warranty of the reliability or accuracy
of the document or electronic image, or create any liability on the part of the state,
department, office, agency of the state, state officer, state employee, or agent of the state.

Proposed law adds a provision that prohibits the office of motor vehicles (OMV) from
making the issuance, renewal, or revocation of a state issued driver's license or identification
card contingent on vaccination verification or immunity status. Prohibits OMV from
including any vaccination verification or immunity status information on a state issued
driver's license or identification card.
