COMMERCIAL REGULATIONS:  Provides relative to the contract limit for certain
common carrier certificate requirements for movers of household goods
1	AN ACT
2To repeal R.S. 45:164(E)(3), relative to common carrier's certificates; to provide relative to
3 intrastate movers of household goods; to remove the contract limit for certain
4 common carrier certificate requirements for movers of household goods; and to
5 provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 45:164(E)(3) is hereby repealed in its entirety.

Abstract:  Removes a provision of law that exempts contracts for moving household goods
from the regulation of common carriers, if the contract is for less than $400.
Present law provides that prior to engaging in any activities related to moving household
goods, an intrastate mover of household goods must meet certain requirements, including
securing a common carrier certificate from the La. Public Service Commission
(commission), meeting other requirements of the commission, and carrying motor truck
cargo carriers insurance of at least $50,000 per truck and $100,000 per catastrophe.
Present law requires any carrier, whether domiciled in or outside of La., who is providing
intrastate transportation of household goods in La., to maintain a permanent establishment
in this state. Provides that if the carrier ceases to maintain a permanent establishment in the
state, its right to conduct business in the state shall be immediately suspended or cancelled
at the discretion of the commission. No cancellation shall be ordered by the commission
without notice and hearing before an administrative law judge.

The provisions of present law shall apply only when the contract for moving household
goods exceeds $400.
